recorded until it shall have been submitted to and approved by the Planning <br />Board of the County of Cabarrus as provided hereinafter in this Ordinance. <br />plat shall be recorded by the Cabarrus County Register of Deeds until this <br />approval is entered in writing on the face of the plat as herein provided. <br /> <br />No <br /> <br />B. EXEMPTIONS - if the Planning Staff shall determine that the subdivision is <br />exempt from the provisions of this ordinance, the plat shall be endorsed to <br />that effect and may be recorded with the Register of Deeds. <br /> <br />C. APPEAL OF DENIED EXEMPTION - the Subdivider may appeal the denial of a <br />requested exemption to the Cabarrus County Planning Board. This appeal must be <br />made within 30 days of notification of the Planning Staff's decision and must <br />be made to the Planning Board in writing. The Planning Board shall calendar <br />all such appeals for hearing giving written notice to the subdivider and the <br />Planning Staff at least ten days prior to the hearing. The Planning Board in <br />all such appeals shall make findings of fact in support of its decision. The <br />proposed subdivider shall be notified in writing of the Planning Board's <br />decision within 10 days after the said decision is made. <br /> <br />SECTION 3.2 SKETCH PLAT REQUIREMENTS <br /> <br />A. GENERAL - prior to filing of a preliminary plat the subdivider is encouraged <br />to submit a preapplication sketch plat to the Planning Department in order that <br />the divider may be aware of the purpose and objectives of these regulations and <br />to assist the subdivider in planning his development. <br /> <br />B. CONTENTS the sketch plat should be drawn at a scale no smaller than <br />1"=400' and should include the following information: <br /> <br />1. The proposed name and vicinity map of the subdivision. <br /> <br />2. Site topography with contour intervals no greater than 10 feet. <br /> <br />3. Boundary lines and lot lines of the property being subdivided <br />including tentative lot arrangement, size, and number of lots. <br /> <br />4. The name and address of the subdivider. <br /> <br />5. Total acreage of the subdivision. <br /> <br />6. The name, location and rights-of-way of all proposed, dedicated, or <br />existing streets or within 300 feet of the land to be subdivided. <br /> <br />7. Existing uses and proposed uses within the subdivision. <br /> <br />8. Location of water courses. <br /> <br />9. Names of owner(s) and approximate boundaries of all contiguous <br />properties. , <br /> <br />SECTION 3.3 ABBREVIATED PROCEDURE FOR MINOR SUBDIVISIONS <br /> <br />If the Planning Department finds that the sketch plat meets the requirements of <br />a minor subdivision as defined by this ordinance and that there are no adverse <br />effects on the remainder of the parcel or on adjoining property, then the <br />subdivider may proceed with the preparation of a final plat pursuant to Section <br />3.5. Plats for minor subdivisions may be given final approval by the Planning <br />Director. However, if the subdivider owns, leases, holds an option, or holds <br />any legal or equitable interest in any property adjacent to or located directly <br />across a street, easement, road or right-of-way from the property to be sub- <br />divided, the subdivision shall not qualify under the abbreviated procedure. <br /> <br />Furthermore, the abbreviated procedure may not be used a second time within <br />three (3) years on any property less than fifteen hundred (1500) feet from the <br />original property boundaries by anyone who owned, had an option on, or any <br />legal interest in the original subdivision at the time the subdivision received <br />preliminary or final plat approval. <br /> <br />SECTION 3.4 PRELIMINARY PLAT REQUIREMENTS <br /> <br /> <br />
