81 <br /> <br />Kannapolis Sanitary District and the City of <br />Kannapolis vote in favor of merger, the <br />combined territories to be known as the City <br />of Kannapolis and to assume all of the <br />obligations of the Kannapolis Sanitary <br />District and to receive from the Kannapolis <br />Sanitary District all the property rights of <br />the District; from and after merger residents <br />of the Kannapolis Sanitary District would <br />enjoy all of the benefits of the municipality <br />and would assume their proportionate share of <br />the obligations of the City of Kannapolis as <br />merged. <br /> <br />AGAINST merger. <br /> <br /> Section 5. The Clerk to the Board of Commissioners is hereby directed to <br />mail or deliver a certified copy of this resolution to the Cabarrus and Rowan <br />County Boards of Election and the Board of Commissioners for the County of <br />Rowan within three days after the adoption hereof. <br /> <br />Section 6. This resolution shall take effect upon its passage. <br /> <br /> Thereupon, upon motion of Commissioner Hamby, seconded by Commissioner <br />Chairman Lentz, the foregoing resolution entitled: "RESOLUTION CALLING A <br />SPECIAL MERGER REFERENDUM" was passed by the following vote: <br /> <br />Ayes: Commissioners Hamby, Melvin, and Moss and Chairman Lentz <br />Noes: None <br /> <br />Commissioner Hamby introduced the following resolution which was read. <br /> <br />RESOLUTION CALLING A SPECIAL MERGER <br /> REFERENDUM <br /> <br />BE IT RESOLVED by the Board of Commissioners for the County of Cabarrus: <br /> <br /> Section 1. A special merger referendum is hereby called to be held <br />between 6:30 A.M. and 7:30 P.M., on Tuesday, June 9, 1987, in the Royal Oaks <br />Sanitary District and the City of Kannapolis, pursuant to the provisions of <br />G.S. §130A-80, to determine if the Royal Oaks Sanitary District and the City <br />of Kannapolis should merge. The Cabarrus County Board of Elections (the City <br />of Kannapolis being located in Cabarrus and Rowan Counties and the Royal Oaks <br />Sanitary District being located in Cabarrus County) is hereby requested to <br />hold and conduct said referendum in the precincts in the Royal Oaks Sanitary <br />District and the City of Kannapolis that are located in Cabarrus County and to <br />take all necessary steps to that end in accordance with the provisions of Sec- <br />tion 2 of this resolution. <br /> <br /> Section 2. For said referendum, (i) a list of the registered voters <br />residing in the the City of Kannapolis in Cabarrus County has been prepared by <br />the Cabarrus County Board of Elections, a list of the registered voters <br />residing in the City of Kannapolis in Rowan County has been prepared by the <br />Rowan County Board of Elections, and a list of the registered voters residing <br />in the Royal Oaks Sanitary District in Cabarrus County has been prepared by <br />the Cabarrus County Board of Elections and shall be used and open for public <br />inspection and the regular registration books for elections in Cabarrus and <br />Rowan Counties shall also be used and open for public inspection in the <br />manner, under the conditions and at the times and places as provided in the <br />notice of special merger referendum set forth in Section 3 of this resolution, <br />(ii) the registrars, judges and other officers of elections appointed by the <br />Cabarrus County Board of Elections for the several precincts and voting places <br />in the Royal Oaks Sanitary District and the City of Kannapolis in Cabarrus <br />County and by the Rowan County Board of Elections for the several precincts <br />and voting places in the City of Kannapolis in Rowan County shall be the <br />election officers for such precincts and voting places and (iii) the precincts <br />and voting places shall be those fixed by the Cabarrus and Rowan County Boards <br />of Election as provided in said notice set forth in Section 3 of this <br />resolution, subject to change as provided by law. <br /> <br /> <br />
