81 Kannapolis Sanitary District and the City of Kannapolis vote in favor of merger, the combined territories to be known as the City of Kannapolis and to assume all of the obligations of the Kannapolis Sanitary District and to receive from the Kannapolis Sanitary District all the property rights of the District; from and after merger residents of the Kannapolis Sanitary District would enjoy all of the benefits of the municipality and would assume their proportionate share of the obligations of the City of Kannapolis as merged. AGAINST merger. Section 5. The Clerk to the Board of Commissioners is hereby directed to mail or deliver a certified copy of this resolution to the Cabarrus and Rowan County Boards of Election and the Board of Commissioners for the County of Rowan within three days after the adoption hereof. Section 6. This resolution shall take effect upon its passage. Thereupon, upon motion of Commissioner Hamby, seconded by Commissioner Chairman Lentz, the foregoing resolution entitled: "RESOLUTION CALLING A SPECIAL MERGER REFERENDUM" was passed by the following vote: Ayes: Commissioners Hamby, Melvin, and Moss and Chairman Lentz Noes: None Commissioner Hamby introduced the following resolution which was read. RESOLUTION CALLING A SPECIAL MERGER REFERENDUM BE IT RESOLVED by the Board of Commissioners for the County of Cabarrus: Section 1. A special merger referendum is hereby called to be held between 6:30 A.M. and 7:30 P.M., on Tuesday, June 9, 1987, in the Royal Oaks Sanitary District and the City of Kannapolis, pursuant to the provisions of G.S. §130A-80, to determine if the Royal Oaks Sanitary District and the City of Kannapolis should merge. The Cabarrus County Board of Elections (the City of Kannapolis being located in Cabarrus and Rowan Counties and the Royal Oaks Sanitary District being located in Cabarrus County) is hereby requested to hold and conduct said referendum in the precincts in the Royal Oaks Sanitary District and the City of Kannapolis that are located in Cabarrus County and to take all necessary steps to that end in accordance with the provisions of Sec- tion 2 of this resolution. Section 2. For said referendum, (i) a list of the registered voters residing in the the City of Kannapolis in Cabarrus County has been prepared by the Cabarrus County Board of Elections, a list of the registered voters residing in the City of Kannapolis in Rowan County has been prepared by the Rowan County Board of Elections, and a list of the registered voters residing in the Royal Oaks Sanitary District in Cabarrus County has been prepared by the Cabarrus County Board of Elections and shall be used and open for public inspection and the regular registration books for elections in Cabarrus and Rowan Counties shall also be used and open for public inspection in the manner, under the conditions and at the times and places as provided in the notice of special merger referendum set forth in Section 3 of this resolution, (ii) the registrars, judges and other officers of elections appointed by the Cabarrus County Board of Elections for the several precincts and voting places in the Royal Oaks Sanitary District and the City of Kannapolis in Cabarrus County and by the Rowan County Board of Elections for the several precincts and voting places in the City of Kannapolis in Rowan County shall be the election officers for such precincts and voting places and (iii) the precincts and voting places shall be those fixed by the Cabarrus and Rowan County Boards of Election as provided in said notice set forth in Section 3 of this resolution, subject to change as provided by law.
