82 <br /> <br /> Section 3. The Clerk to the Board of Commissioners for the County of <br />Cabarrus and the Clerk to the Board of Commissioners for the County of Rowan, <br />as authorized by the Board of Commissioners for the County of Rowan, shall <br />cause a notice to be published in The Daily Independent once at least fourteen <br />days before May 11, 1987 (being the last day on which the registration list <br />will be available for public inspection and the last day on which persons may <br />register for said referendum except as otherwise provided in said notice set <br />forth in section 3 of this resolution) and once again not less than seven days <br />before said day, such notice to read substantially as follows: <br /> <br /> NOTICE OF SPECIAL MERGER REFERENDUM <br />IN THE ROYAL OAKS SANITARY DISTRICT AND THE <br /> CITY OF KANNAPOLIS, NORTH CAROLINA <br /> <br /> A special merger referendum will be held throughout the Royal Oaks <br />Sanitary District and the City of Kannapolis between 6:30 A.M. and 7:30 P.M., <br />on Tuesday, 3une 9, 1987, at which there will be submitted to the qualified <br />voters of the Royal Oaks Sanitary District and the City of Kannapolis the <br />following question: <br /> <br />"FOR merger of the City of Kannapolis and the <br />Royal Oaks Sanitary District, if a majority of the <br />registered voters of both the Royal Oaks Sanitary <br />District and the City of Kannapolis vote in favor <br />of merger, the combined territories to be known as <br />the City of Kannapolis and to assume all of the <br />obligations of the Royal Oaks Sanitary District <br />and to receive from the Royal Oaks Sanitary <br />District all the property rights of the District; <br />from and after merger residents of the Royal Oaks <br />Sanitary District would enjoy all of the benefits <br />of the municipality and would assume their <br />proportionate share of the obligations of the City <br />of Kannapolis as merged. <br /> <br />AGAINST merger." <br /> <br /> On such date, there will also be held a merger election at which there <br />will be submitted to the qualified voters of the City of Kannapolis and the <br />Kannapolis Sanitary District a proposition for the merger of the Kannapolis <br />Sanitary District with the City of Kannapolis. Each such merger election will <br />be independent of the other. <br /> If a majority of the registered voters of both the Royal Oaks Sanitary <br />District and the City of Kannapolis vote in favor of merger, the combined <br />territories to be known as the City of Kannapolis and to assume all of the <br />obligations of the Royal Oaks Sanitary District and to receive from the Royal <br />Oaks Sanitary District all the property rights of the District; from and after <br />merger residents of the Royal Oaks Sanitary District would enjoy all of the <br />benefits of the municipality and would assume their proportionate share of the <br />obligations of the City of Kannapolis as merged. Upon any such merger, the <br />City of Kannapolis shall assume all obligations of the Royal Oaks Sanitary <br />District, such sanitary district shall convey all of their respective property <br />rights to the City of Kannapolis and such sanitary district shall cease to <br />exist as political subdivisions. <br /> <br /> A list of the registered voters residing in the City of Kannapolis in <br />Cabarrus County has been prepared by the Cabarrus County Board of Elections, a <br />list of the registered voters residing in the City of Kannapolis in Rowan <br />County has been prepared by the Rowan County Board of Elections and a list of <br />the registered voters residing in the Royal Oaks Sanitary District has been <br />prepared by the Cabarrus County Board of Elections and such lists shall be <br />used and open for public inspection and the regular registration books, <br />process or records for elections in Cabarrus County and Rowan Counties shall <br />also be used and open for public inspection as herein set forth. For said <br />referendum the three lists of registered voters heretofore mentioned and the <br />regular registration books, process or records for elections in Cabarrus <br />County and Rowan County will be used and will continue to be open for the <br />acceptance of registration applications and the registration of qualified <br />persons from 8:00 A.M. until 5:00 P.M. on Monday through Friday, inclusive, of <br />each week at the office of the Cabarrus County Board of Elections located at <br /> <br /> <br />
