89 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Tuesday, <br />April 21, 1987, at 7:00 P.M. The meeting had been changed from Monday, <br />April 20, 1987, due to the observance of Easter Monday. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The invocation was given by Reverend James A. Summey of the Kerr Street <br />Baptist Church. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the minutes of April 6 and April 13, 1987, were approved <br />as written. <br /> At 7:00 P.M., Chairman Lentz stated that the public hearing for the <br />proposed Zoning Atlas amendments would be held at this time. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, pre- <br />sented each of the proposed Zoning Atlas amendments as recommended by the <br />Planning Board. Mr. Phillip Kingsland, member of the County Planning staff, <br />reviewed the location of each of the areas proposed for rezoning. Public <br />input was received prior to action by the Board. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 87-02. Larry E. Morris, off Highway 29, township 2, Map/PIN <br />5509-55-2614. Wishes to rezone from A-I to C-3. Planning Board voted <br />3 to 1 to recommend denial. (Tabled) <br /> <br /> The Board received the letter dated April 15, 1987, from Mr. Larry E. <br />Morris requesting that Petition 87-02 be withdrawn at this time. <br /> <br />(2) <br /> <br />Petition 87-09. Worth P. Hinson, Jr., at the corner of Lane Street and <br />Wright Avenue, Township 4, Map/PIN 5624(19)-61-5597, 6551. Wishes to <br />rezone from C-1 to C-3. Planning Board voted 4 to 1 to recommend <br />approval. <br /> <br /> Mr. Farrar Griggs, attorney representing the petitioner, spoke in support <br />of the proposed rezoning and reviewed the zoning history of the property. <br />Stating that petitions to rezone the property to C-3 had been denied by the <br />Board in November, 1982, and March, 1984, because of neighborhood concerns, <br />Mr. Griggs presented a petition which he stated contained 152 signatures of <br />Jackson Park Community residents who support the current rezoning request. A <br />number of persons in the audience stood in support of Mr. Hinson's rezoning <br />petition. <br /> No one spoke in opposition to the rezoning petition. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Moss and <br />unanimously carried, the Board approved Petition 87-09 by Worth P. Hinson, <br />Jr., to rezone property at the corner of Lane Street and Wright Avenue, <br />Map/PIN 5624(19)-61-5597, 6551, from C-1 to C-3. <br /> <br />(3) <br /> <br />Petition 87-10. Guy Deaton, off Charlie Walker Road, township 4, Map/PIN <br />5604(18)-31-5406. Wishes to rezone from R-15 to R-30. Planning Board <br />voted unanimously to recommend denial. <br /> <br /> Ms. Bobbie Steele, resident of Charlie Walker Road, spoke in opposition <br />to the rezoning petition, stating that the trailers currently located in the <br />neighborhood had lowered the value of her home. She also complained of junk <br />yards located in the area. <br /> Mr. Lonnie Tucker, resident of 5284 Woodside Street, protested the <br />location of a paint shop across the street from his home and complained of the <br />paint fumes generated by the shop. <br /> Mr. F. E. Isenhour, Jr., Zoning Administrator, advised the Board there <br />was a la'it pending against Mr. Ralph Smith who operates a salvage yard in <br />the area and that he would ask the Building Inspection Department to look into <br />the paint shop operation. <br />There was no one present to speak in support of the rezoning petition. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin with <br />Commissioners Payne and Melvin and Chairman Lentz voting for and Commissioners <br />Hamby and Moss voting against, the Board denied Petition 87-10 by Guy Deaton <br />to rezone property off Charlie Walker Road from R-15 to R-30. <br /> <br /> <br />
