Grossman <br />from the Senior Citizens Advisory Council because of business commitments. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin and <br />unanimously carried, the Board tabled the appointment to the Senior Citizens <br />Advisory Council until the next meeting. <br /> B. S. Brown, Jr., representing the Kannapolis Sanitary District, presented <br />the following resolution which was read: <br /> <br />RESOLUTION RELATING TO THE ANNEXATION OF <br />TERRITORY TO KANNAPOLIS SANITARY DISTRICT <br /> <br /> BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF CABARRUS: <br /> Section 1. That the Board of Commissioners for the County of Cabarrus <br />has determined and does hereby find and declare: <br /> (a) That on April 17, 1987 a resolution was received from the Sanitary <br />District Board of the Kannapolis Sanitary District relating to the annexation <br />of territory to the Kannapolis Sanitary District. <br /> (b) That the territory described in the petition consists of the property <br />of Robert L. Bare and others. <br /> (c) That the petition was signed by all property owners within the area <br />requested to be annexed. <br /> (d) That said petition requests that all necessary action required by <br />Part 2 of Article 2 of Chapter 130A of the General Statutes of North Carolina <br />for the extension of the boundaries of the Kannapolis Sanitary District be <br />taken so as to annex the territory described in the petition unto the <br />Kannapolis Sanitary District. <br /> (e) That it is for the best interest of the Kannapolis Sanitary District <br />and the territory requested to be annexed unto the Kannapolis Sanitary District <br />that said territory be included with the boundaries of the Kannapolis Sanitary <br />District and receive the services of the Sanitary District. <br /> Section 2. That the Board of Commissioners for the County of Cabarrus <br />does hereby approve the annexation of the territory described in the petition <br />unto the Kannapolis Sanitary District and does hereby recommend to the North <br />Carolina Commission for Health Services that it approve the annexation of the <br />territory unto the Kannapolis Sanitary District. <br /> Section 3. That the Clerk of the Board of Commissioners for the County <br />of Cabarrus is hereby directed to certify a copy of this resolution to the <br />Director, Division for Health Services, Department of Human Resources, State <br />of North Carolina. <br /> Thereupon, upon motion of Commissioner Hamby, seconded by Commissioner <br />Chairman Lentz, the foregoing resolution entitled: "RESOLUTION RELATING TO <br />THE ANNEXATION OF TERRITORY TO KANNAPOLIS SANITARY DISTRICT" was passed by the <br />following vote: <br /> Ayes: Chairman Lentz and Commissioners Payne, Hamby, Melvin, and Moss <br /> Noes: None <br /> <br /> The boundaries of the territory petitioned to be annexed to and included <br />in the Kannapolis Sanitary District are as follows: <br /> <br />BEGINNING at a point where the eastern edge of U. S. Highway 29 inter- <br />sects the boundary line of the Kannapolis Sanitary District, this point <br />lying North 20-21 East 4 feet, more or less, from the northeastern corner <br />of the intersection of East 28th Street and U. S. Highway 29 and runs <br />thence along the eastern line of U. S. Highway 29 in four courses as <br />follows: (1) North 20-21 East 96 feet, more or less, to a stake; (2) <br />North 22-14 East 100 feet to a stake; (3) North 24-16 East 100 feet to a <br /> <br /> <br />
