159 <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and <br />unanimously carried, the Board moved that the public hearing for the closing <br />of a portion of White Street scheduled for August 17, 1987, be rescinded, <br />that a public hearing regarding the closing of a portion of White Street be <br />declared for 7:30 P.M. on September 21, 1987, and that the following <br />resolution be adopted. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT TO CLOSE AN <br /> EASEMENT DEDICATED FOR A PUBLIC ROAD <br /> <br /> WHEREAS, at the July 20, 1987, meeting of the Board of Commissioners for <br />Cabarrus County, the Board acknowledged a request to close an easement <br />dedicated for a public road, commonly known as "white Street" in Cabarrus <br />County, North Carolina; <br /> <br /> WHEREAS, it is the intention of the Board of Commissioners to conduct a <br />public hearing, pursuant to N.C.G.S. 153A-241, to close that portion of White <br />Street, more particularly described as follows: <br /> <br /> BEGINNING at a point, the northwest corner of Lot 36, Block E, of <br />Fred E. Funderburk, as set forth in Map Book 8, Page 10, of the Cabarrus <br />County Registry; thence in a northeasterly direction crossing White <br />Street as shown on said plat to a point, the southwest corner of Lot 81, <br />Block C, of Fred E. Funderburk; thence with White Street as dedicated <br />and the front of Lots 82-93 to an axle, a corner of Lot 93, Block C, and <br />the Subdivision of B. L. Umberger Estate and the dedicated portion of <br />White Street; thence in an easterly direction crossing White Street as <br />dedicated to a point, a corner of Lots 50 and 51, Block E, of Fred E. <br />Funderburk; thence with White Street as dedicated and the front lines of <br />Lots 37-50, Block E, of Fred E. Funderburk to the BEGINNING. <br /> <br /> WHEREAS, the Board of Commissioners of Cabarrus County desires to notify <br />the public regarding said public hearing on the issue of closing said public <br />road/easement. <br /> <br />BE IT, THEREFORE, RESOLVED that: <br /> <br /> 1. A meeting and public hearing on the closing of that portion of White <br />Street heretofore identified shall be held before the Board of Commissioners <br />of Cabarrus County at 7:30 P.M. on the 21st day of September, 1987. <br /> <br /> 2. This resolution declaring intent to close an easement dedicated for <br />a public road shall be published in The Concord Tribune on Monday, August 24 <br />and 31, 1987, and September 7 and 14, 1987, and shall be prominently posted <br />in at least two places along said road or easement. <br /> <br /> 3. At said hearing, the Board of Commissioners shall hear all interested <br />person who appear with respect with whether the closing would be detrimental <br />to the public interest or to any individual property rights. <br /> <br />This the 3rd day of August, 1987. <br /> <br />ATTEST: <br />/s/ Frankie F.
