168 <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into this 17th day of August, 1987, by <br />and between CITY OF CONCORD, a municipal corporation of the State of North <br />Carolina, hereinafter referred to as "CONCORD" and CABARRUS COUNTY, a <br />governmental subdivision of the State of North Carolina, hereinafter referred <br />to as "CABARRUS"; <br /> <br />WITNESS ETH : - <br /> <br /> That whereas, Concord operates a library in the municipal limits known as <br />"Cannon Memorial Library" and has operated the same for a number of years; and <br />whereas, Cabarrus makes appropriations to said library; and whereas, Cabarrus <br />desires to establish a branch library in the Town of Kannapolis and at future <br />times to establish branch libraries in other parts of Cabarrus County; and <br />whereas, it is desired that Concord administer the entire library system in <br />the manner hereinafter provided for in this contract. <br /> NOW, THEREFORE, in consideration of the premises and the mutual <br />agreements hereinafter made, the parties do agree as follows: <br /> 1. That Cabarrus will establish a County library system with the first <br />branch to be in the Town of Kannapolis, North Carolina, and will fund said <br />system and will continue to make contributions to Concord for the operation of <br />the Cannon Memorial Library in the City of Concord. <br /> 2. That Concord will administer the entire library system and will be <br />solely responsible for the emplo3anent of the Head Librarian (Library Director) <br />of the system and for the employment of the staff of the Cannon Memorial <br />Library. <br /> 3. The Head Librarian and all personnel in the Cannon Memorial Library <br />will be employees of Concord and all final decisions concerning them will be <br />made by Concord. <br /> 4. The Head Librarian and the Board of Library Trustees of Cabarrus <br />will recommend to the Cabarrus County Manager persons to be Chief Branch <br />Librarians for each branch of the library system. The County Manager will <br />then select and employ the Chief Branch Librarian for each branch. Each <br />candidate must be certified by the State of North Carolina. After consul- <br />tation with the Head Librarian, each Chief Branch Librarian, with the approval <br />of the Cabarrus County Manager, will hire personnel for the branch. The Chief <br />Branch Librarians and all branch personnel shall be County employees. <br /> 5. The salaries and benefits for personnel at the branch libraries <br />initially shall be based on the salary schedule and benefits available to <br />employees of Concord at the Cannon Memorial Library. Future changes in <br />salaries and benefits shall be determined by Concord and Cabarrus for the <br />employees of each. <br /> 6. The budget for the branch libraries shall be proposed by the Head <br />Librarian to the Board of Library Trustees after receipt of requests from all <br />branches. The Board of Library Trustees shall review the budget, consult with <br />Concord and make recommendations to Cabarrus concerning the budget. The <br />budgets shall separately identify costs for each branch. The budget for the <br />Cannon Memorial Library shall be adopted by Concord. The budget for the <br />branch libraries shall be adopted by Cabarrus. <br /> 7. Title to the Cannon Memorial Library and all of the books and other <br />assets in said library shall be and remain with Concord. Title to the real <br />property and all books and other assets of the branch libraries shall be and <br />remain with Cabarrus. Title to assets acquired in the future for the Cannon <br />Memorial Library will be in Concord and title to assets acquired in the future <br />by the branch libraries shall be in Cabarrus. <br /> 8. All purchases of books, supplies and all expenditures of money shall <br />be made by the Head Librarian under the provisions of the Local Government <br />Finance Act. <br /> 9. Contributions to the County library system by persons, firms, <br />interest groups or governmental subdivisions to fund particular items may be <br />accepted and used for the purposes designated subject to approval by the Head <br />Librarian and the Board of Library Trustees. <br /> 10. This Contract shall be effective upon its execution and shall remain <br />in force and effect through December 31, 1990. The Contract may be renewed by <br />joint agreement of Concord and Cabarrus. <br /> <br /> <br />
