185 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />September 21, 1987, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The invocation was given by Reverend F. Donald Beaty of Central United <br />Methodist Church. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and <br />unanimously carried, the minutes of September 8 and 11, 1987, were approved as <br />written. <br /> At 7:00 P.M. Chairman Lentz stated that the public hearing for the <br />proposed Zoning Atlas and Text amendments would be held at this time. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, pre- <br />sented each of the proposed Zoning Atlas and Text amendments as recommended by <br />the Planning Board. Mr. Phillip Kingsland, member of the County Planning <br />staff, reviewed the location of the areas proposed for rezoning. Public input <br />was received prior to action by the Board. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 87-20. Jeffrey Carter, off Lake Lynn Road, township 11, Map/PIN <br />5640-67-6455. Wishes to rezone from ARR to I-1/PDO. The Planning Board <br />voted unanimously to recommend denial. <br /> <br /> The Board acknowledged the written notice from Mr. Jeffrey W. Carter <br />requesting to withdraw Petition 87-20. <br /> <br />(2) <br /> <br />Petition 87-25. Bobby Alexander, off Trinity Church Road, township 4, <br />Map/PIN 5601-59-9411. Wishes to rezone from I-2 to C-4. The Planning' <br />Board voted unanimously to recommend denial. <br /> <br /> Mr. Carlos Moore, speaking on behalf of the petitioner, requested that <br />the property be rezoned to C-1 to allow construction of a convenience store. <br />He stated in his opinion the intersection located at the property would not be <br />dangerous if controlled properly. <br /> Mr. Bobby Alexander, petitioner, stated the need for the intersection at <br />the site of the property to be controlled. <br /> There being no one else to speak regarding the proposed amendment, <br />Chairman Lentz closed the public hearing. <br /> The motion by Commissioner Payne and seconded by Commissioner Hamby to <br />deny Petition 87-25 failed with Commissioners Payne and Hamby voting for and <br />Commissioners Melvin and Moss and Chairman Lentz voting, against. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin with <br />Commissioners Moss and Melvin and Chairman Lentz voting for and Commissioners <br />Hamby and Payne voting against, the Board approved Petition 87-25 by Bobby <br />Alexander to rezone property off Trinity Church Road, Map/PIN 5601-59-9411, <br />from I-2 to C-4. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />(1) <br /> <br />Petition 87-09. Cabarrus County Planning Staff. Section 16 - Defini- <br />tions, Page 142, Mobile Home Subdivisions. Amend to read: <br /> <br />Mobile Home Subdivisions - A subdivision regulated by the Cabarrus County <br />Subdivision Regulations containing 5 or more Class II mobile homes. Any <br />subdivision approved preliminary or final prior to August 1, 1987, shall <br />be exempt from this definition. However, a revision to a previously <br />approved subdivision is not exempt from this definition. <br /> <br />The Planning board voted unanimously to recommend approval. <br /> <br /> Mr. Ernest Smith spoke in favor of the proposed amendment. <br /> There being no one else present to speak regarding the proposed amend- <br />ment, Chairman Lentz closed the public hearing. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board approved Petition 87-09 to amend Section 16 - <br />Definitions, Page 142, Mobile Home Subdivisions to read as follows: <br /> <br /> <br />
