189 <br /> <br /> WHEREAS, all parties hereto have an interest in the sanitary sewer <br />easement which is located on the common boundary between lot numbers 35 and 36 <br />of Camelot Subdivision, and said parties desire to relocate said sewer ease- <br />ment from its present location shown on the plats of Phase I of Camelot <br />Subdivision recorded in Map Book 21, Pages 30 and 31, Cabarrus County Registry <br />to the new location shown on Exhibit "A" attached hereto; <br /> <br /> NOW, THEREFORE, for ten dollars ($10.00) and other valuable considera- <br />tion, the receipt and sufficiency of which is hereby acknowledged, the parties <br />hereby withdraw from dedication and delete the sanitary sewer easement 20 feet <br />in width located on the common boundary between lot numbers 35 and 36 as shown <br />on the plats of Phase I of Camelot Subdivision, Map Book 21, Pages 30 and 31, <br />Cabarrus County Registry. The parties hereby RELOCATE said sewer easement and <br />DEDICATE the following strip of land 20 feet in width as a sanitary sewer <br />easement for Camelot Subdivision as if the following described strip of land <br />had been originally shown on said plats of Camelot Subdivision: <br /> <br /> Lying and Being in Number One (1) Township, Cabarrus County, North <br />Carolina, and being a strip of land 20 feet in width across part of lot number <br />35 and part of lot number 36 of Phase I, Camelot Subdivision, Map Book 21, <br />Page 31 and Page 30, respectively, and being 10 feet on either side of a <br />center line which is described more particularly as follows: <br /> <br /> BEGINNING at a point in the northern right of way line of Somerset Lane, <br />said point being North 53-11-54 East 160 feet from the front common corner of <br />lot numbers 36 and 37, Phase I, Map I, Camelot Subdivision, Map Book 21, Page <br />30, and runs thence North 35-52-43 West 200.29 feet to an iron, the rear <br />common corner of lot number 35, Phase I, Map 2, Camelot Subdivision, Map Book <br />21, Page 31, and lot number 36, Phase I, Map I, Camelot Subdivision, Map Book <br />21, Page 30, Cabarrus County Registry, as shown on Exhibit "A" attached hereto <br />and incorporated herein by reference. <br /> <br /> IN WITNESS WHEREOF, the parties have caused this instrument to be signed <br />in their corporate names by their duly authorized officers and officials and <br />their seals affixed hereto, the day and year first above written. <br /> <br />C. McNeil, President of M & M Minerals, Inc., regarding permission <br />to remove sand from the proposed Coddle Creek impoundment. Mr. Paul Watson, <br />Engineer with HDR Infrastructure, Inc., recommended that he work with the <br />County Manager and the County Attorney to revise the proposed Sand Dredging <br />Agreement for consideration by the Board at a later date. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board tabled consideration of the sand dredging <br />request until the meeting on October 19, 1987. <br /> Mr. Charles D. McGinnis, County Manager, stated that the item regarding <br />the transfer of equipment to the City of Concord had been withdrawn from the <br />agenda. Mr. Steve Little, Recreation Director, is preparing a report regard- <br />ing the requested transfer of materials purchased with Community Based Alter- <br />natives Wilderness Adventure Program funds to the City of Concord. <br /> <br /> <br />
