188 <br /> <br /> WHEREAS, at its regular meeting in the Commissioner's Room of the <br />Cabarrus County Courthouse at 7:30 P.M. on September 21, 1987, the Board <br />considered such resolution; and <br /> <br /> WHEREAS, at the meeting and hearing on September 21, 1987, the Board <br />considered all cox~ents before it and determines that the closing of the <br />Easement is not contrary to the public interest, and no individual owning <br />property in the vicinity of the Easement would be deprived of a reasonable <br />means of ingress and egress, nor would be aggrieved by the closing of that <br />portion of the Easement more particularly described as follows: <br /> <br /> BEGINNING at a point, the northwest corner of Lot 36, Block E, of <br />Fred E. Funderburk, as set forth in Map Book 8, Page 10, of the Cabarrus <br />County Registry; thence in a northeasterly direction crossing White <br />Street as shown on said plat to a point, the southwest corner of Lot 81, <br />Block C, of Fred E. Funderburk; thence with White Street as dedicated and <br />the front of Lots 82-88 to a point, a corner of Lots 88 and 89, Block C, <br />on the northeastern side of White Street; thence in a generally south- <br />westerly direction crossing White Street as dedicated to a point, a <br />corner of Lots 43 and 44, Block E, of Fred E. Funderburk; thence with <br />White Street as dedicated and the front lines of Lots 37-43, Block E, of <br />Fred E. Funderburk to the BEGINNING. <br /> <br /> BE IT, THEREFORE, ORDERED that that portion of the Easement hereinbefore <br />described be and the same is hereby closed to the public and, subject to the <br />right-of-way and easement previously granted by the abutting landowners to <br />Cabarrus County, pursuant to N.C.G.S. 153A-241, title of each abutting land- <br />owner, for the width of his abutting land, hereafter extends to the center <br />line of that portion of the Easement hereby closed. <br /> <br />This the 21st day of September, 1987. <br /> <br />ATTEST: <br />/s/ Frankie F. Lentz <br /> <br /> Mr. Douglas Zawiskie, architect with Kimball and Associates, reported <br />that insufficient bids had been received on this date for the Jail construc- <br />tion project. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne and unani- <br />mously carried, the Board moved to readvertise for~ bids for the Jail annex <br />project with bids to be received at 2:00 P.M. on Tuesday, October 20, 1987, in <br />the Commissioners' Meeting Room. <br /> Ms. Queen Harris, speaking on behalf of the 12 property owners on Urban <br />Drive, questioned why that street had not been paved and Maderia Drive and <br />Barrington Street had been paved. She stated there were 12 homes on Urban <br />Drive and three school buses traveled the street daily during the school year. <br /> Chairman Lentz explained that the County was not involved with the paving <br />of roads in the County. However, he directed Mr. James F. Owens, Planning <br />Director, to contact the Department of Transportation regarding Urban Drive <br />and to report his findings to Ms. Harris within the next ten days. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz and unani- <br />mously carried, the Board approved the following Sewer Easement Relocation. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />RELOCATION OF SEWER EASEMENT <br /> <br /> THIS INSTRUMENT, made and entered into this 21st day of September, 1987, <br />by and between C. F. LITTLE DEVELOPMENT CORPORATION, RICHARD D. SUGGS and wife <br />SHERRY B. SUGGS, and CABARRUS COUNTY; and <br /> <br /> WHEREAS, C. F. Little Development Corporation is the owner of part of lot <br />THIRTY SIX (36) PHASE I, MAP I, CAMELOT SUBDIVISION, Map Book 21, Page 30, <br />Cabarrus County Registry and Richard D. Suggs is the owner of lot THIRTY FIVE <br />(35), PHASE I, MAP 2, CAMELOT SUBDIVISION, Map Book 21, Page 31, Cabarrus <br />County Registry and Richard D. Suggs is also the owner of the remaining <br />portion of lot THIRTY SIX (36), PHASE I, MAP I, CAMELOT SUBDIVISION, Map Book <br />21, Page 30; and <br /> <br /> <br />
