240 <br /> <br />of this ordinance may be enforced through the issuance of citations by <br />the Zoning Office in accordance with G.S. 153A-123. These citations are <br />in the form of a civil penalty. The County may recover this penalty in a <br />civil action in the nature of a debt if the offender does not pay the <br />penalty within 72 hours after being cited for a violation. In addition, <br />failure to pay the civil penalty within 72 hours may subject the violator <br />to criminal charges. <br /> <br />The following civil penalties are established for violations under this <br />section. <br /> <br />Warning citation <br />First citation <br />Second citation for same offense <br />Third and subsequent citations <br /> for same offense <br /> <br />Correct violation within 10 days <br />$ 25.00 <br />$ 50.00 <br /> <br />$100.00 <br /> <br />These civil penalties are in addition to any other penalties which may be <br />imposed by a court for violation of the provisions of the zoning <br />ordinance. <br /> <br />Planning Board voted unanimously to approve this petition. <br /> <br /> Mr. F. E. Isenhour, Jr., Zoning Administrator, reviewed the proposed <br />amendment which he stated would provide a tool for enforcement of the Zoning <br />Ordinance. <br /> There was no one present to speak against the proposed amendment, and the <br />public hearing was closed. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 87-18 to amend Section 12, <br />Subsection 12.1, page 128 as recommended by the Planning Board and as stated <br />above. <br /> <br />(3) <br /> <br />Tabled from Last Commissioners Meeting. <br />Petition 87-11. Planning Staff, Section 5.8, Off-Street Parking Require- <br />ments, page 64. Amend Subsection A to read as follows: <br /> <br />Application of Regulations: Any structure or building hereafter <br />erected or structurally altered or placed on a lot shall be provided <br />with off-street vehicle parking spaces located not more than three <br />hundred (300) feet at the nearest point from the building entrance. <br />Parking spaces and loading areas shall be paved for all uses other <br />than single-family or two-family residential units and shall be <br />provided with permanent wheel steps, curb guards, or other barriers <br />which will prevent any part of any vehicle to over-lay into sidewalk <br />areas or vehicular passageways adjacent to the parking area. <br />Required parking areas shall be available for the parking of <br />operable vehicles of residents, customers and employees, and shall <br />not be used for the storage of vehicles or materials, or for the <br />parking of vehicles used for loading or unloading. Required loading <br />space shall be available for the loading and unloading of vehicles, <br />and shall not be used for the storage of vehicles or materials, or <br />to meet off-street parking requirements, or in conducting the use. <br /> <br />Planning Board voted 4-0 to approve this petition. <br /> <br /> Mr. James F. Owens, Planning Director, stated that the word "over-lay" <br />should be changed to "over-hang". <br /> There was no one present to speak for or against the proposed amendment, <br />and the public hearing was closed. <br /> Motion by Commissioner Payne to approve Petition 87-11 failed for lack of <br />second. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin with <br />Commissioners Moss, Melvin, and Hamby, and Chairman Lentz voting for and <br />Commissioner Payne voting against, the Board moved to deny Petition 87-11 in <br />regards to Off-Street Parking Regulations. <br /> <br /> Mrs. Tina C. Loving, Chairman of the Cabarrus County Board of Education, <br />presented the request that the Board of Commissioners call for a $25 million <br />bond election on March 8, 1988, to provide school facility needs in Cabarrus <br /> <br /> <br />
