244 <br /> <br />"Health Director" - the director of the Cabarrus County Health Department <br />or his authorized representative. <br />"Board of Health" - the Cabarrus County Board of Health. <br />"County Commissioners" the Board of Commissioners of Cabarrus County. <br /> <br />SECTION II - GENERAL CONDITION <br /> <br />Ail solid waste shall be stored, collected, transported, treated, <br />utilized, processed, reclaimed, recycled and disposed of in a manner <br />consistent with the requirements and intent of this ordinance. <br />Notwithstanding other provisions of this ordinance, no radioactive solid <br />waste shall be collected and transported, stored, treated, processed, or <br />reclaimed, except as specifically authorized by a radioactive material <br />license issued by the State Division of Facilities Services, Radiation <br />Protection Branch. No radioactive solid wastes shall be disposed of in <br />Cabarrus County without prior approval of the Health Director. <br />Regulations pertaining to the management of solid waste may be promul- <br />gated by the County Commissioners or the Board of Health. Not less than <br />10 days before the adoption, amendment or repeal of any local board of <br />health rule, the proposed rule shall be made available at the office of <br />each county clerk within the board's jurisdiction, and a notice shall be <br />published in a newspaper having general circulation within the area of <br />the board's jurisdiction. The notice shall contain a statement of the <br />substance of the proposed rule or a description of the subjects and <br />issues involved, the proposed effective date of the rule and a statement <br />that copies of the proposed rule are available at the local health <br />department. A local board of health rule shall become effective upon <br />adoption unless a later effective date is specified in the rule. <br />The Health Director shall be the primary official charged with the <br />administration, supervision, execution and initial enforcement of regu- <br />lations pertaining to the management of solid waste. <br /> <br />SECTION III SOLID WASTE STORAGE <br /> <br />No person owning or occupying any premises shall permit any solid waste to <br />accumulate upon such premises that is not stored in a manner approved by the <br />Board of Health. <br /> <br />SECTION IV - SOLID WASTE REMOVAL <br /> <br />The owner and occupier of all premises upon which garbage or other solid <br />waste is stored shall remove or cause to be removed all such materials <br />from their premises at least once a week. <br />It shall be the specific responsibility of the owners of mobile home <br />parks and apartment houses or complexes to provide for the collection and <br />removal of all refuse from the premises at least once per week. Such <br />mobile home parks and apartment complexes, when services are rendered to <br />all residents pursuant to a single contract with the owner or manager <br />thereof, shall be deemed to be a commercial venture for the purposes of <br />Section X herein. <br /> <br />SECTION V - SOLID WASTE TRANSPORTATION <br /> <br />No person for hire shall transport solid waste in a conveyance that has not <br />been inspected and approved by the Health Director and certified as being in <br />compliance with rules promulgated by the Board of Health. <br /> <br />SECTION VI - SOLID WASTE DISPOSAL <br /> <br />No garbage or solid waste generated outside of Cabarrus County shall be <br />disposed of in the county's landfill. <br /> <br />No person shall dispose of solid waste except by one of the following methods: <br /> <br />By burying in a sanitary landfill that is permitted by the Solid and <br />Hazardous Waste Branch of the North Carolina Department of Human <br />Resources. <br />This ordinance shall not be construed to obstruct the recycling of <br />garbage or solid waste. <br /> <br /> <br />
