245 <br /> <br />SECTION VII - APPLICATIONS FOR SOLID WASTE FRANCHISES <br /> <br />Ail persons applying for a solid waste franchise for the collection or trans- <br />portation of solid waste shall first file a formal written application with <br />the Health Director containing such information as may be requested by the <br />Health Director, including, but not limited to, the nature of the applicant's <br />equipment and the territory in which the applicant desires to operate. <br /> <br />SECTION VIII - COLLECTION OF SOLID WASTE <br /> <br />Co <br /> <br />No person for hire shall collect or transport solid waste without a <br />franchise. Residential collection shall be accomplished once each week <br />at a frequency or at intervals specified by the Health Director, except <br />in the following conditions: <br />1. No collection of garbage by franchise haulers is required to be made <br /> on days that snow is on the roads. <br />2. Only road side garbage pickup is required when snow remains on the <br /> ground or when the county's landfill is closed. <br />3. Garbage secured in out buildings need not be picked up. <br />Garbage shall be secured in approved refuse containers being watertight, <br />rust-resistant, easily emptied, equipped with a tight fitting lid and not <br />to exceed 32 gallons. <br />Weekly volume shall be limited to a maximum of 5-32 gallon containers or <br />the equivalent of 160 gallons per household. <br />The Health Director shall annually inspect facilities, equipment, and <br />proposed operating methods of any person making application therefore, <br />and certifying that said facilities, equipment, and operating methods are <br />in compliance with regulations promulgated by the Board of Health. <br /> <br />SECTION IX - FRANCHISES <br /> <br />No person shall collect and transport garbage or solid waste for a fee unless <br />such person holds a valid, current franchise issued by the County Commis- <br />sioners empowering him to so collect and transport garbage or solid waste. <br />The franchise shall define the holder's territory and may include the grant of <br />an exclusive or a non-exclusive commercial license in addition to the grant of <br />an exclusive residential license. <br /> <br />No franchise to collect and transport garbage or solid waste within <br />Cabarrus County shall be valid unless the franchise holder: <br />1. Passes an annual inspection of the facilities, equipment, and <br /> operating methods by the Cabarrus County Health Director; and <br />2. Files with the Health Director's office and County Manager's office <br /> a schedule of his fees; and <br />3. Complies with all rules and regulations promulgated by the County <br /> Commissioners and the Board of Health pertaining to solid waste <br /> management. <br />4. Ail franchise holders will maintain a local telephone number or a <br /> toll free number if operating office is located outside of the <br /> county. <br />Transfer and Abandonment <br />1. No franchise shall be transferred or abandoned by a holder without <br /> at least 30 days prior written notice to the Health Department and <br /> prior approval by the County Commissioners. <br />The franchise areas described in Appendix A, which is attached hereto and <br />made a part hereof, being the franchise areas presently assigned to the <br />persons named therein, are hereby deemed to be effective, unless <br />terminated as provided herein. New or renewal franchises shall be <br />awarded for terms not exceeding five (5) years. <br />Termination and Suspension - Ail or any portion of a franchise may be <br />terminated or suspended for any of the following reasons by the proce- <br />dures provided in Article XV hereof: <br />1. Failure to pass the annual inspection of facilities, equipment, and <br /> operating methods; <br />2. Non-compliance with or violation of the maximum fee schedule promul- <br /> gated by the County Commissioners; <br />3. The attempted transfer of a franchise without prior written approval <br /> of the County Commissioners; <br />4. Collection of refuse or the solicitation of customers outside the <br /> territorial area awarded to the holder of the franchise; <br /> <br /> <br />
