257 <br /> <br />necessary appurtenances including lift stations and force mains. The <br />design shall be in accordance with standard design guidelines as issued <br />by the County Engineer. The applicant's engineer will also be required <br />to furnish a complete set of "Record Drawings" indicating the "As Built" <br />configuration of the project when completed. The County Engineer shall <br />provide specifications for the construction of the project. <br /> <br />The applicant shall obtain all rights-of-way in width satisfactory to the <br />County Engineer. Said rights-of-way shall be obtained in the name of the <br />applicant and transferred to Cabarrus County at the conclusion of the <br />project. <br /> <br />The Applicant agrees to construct the sanitary sewer lines, including any <br />appurtenant-structures and equipment, according to the Plans and Profiles <br />approved by the County Engineer and in strict accordance with the current <br />specifications and design criteria for construction of sanitary sewers in <br />Cabarrus County issued by the County Engineer. <br /> <br />The applicant also agrees to furnish prior written notice to the County <br />Engineer as to the exact date construction will begin, and further agrees <br />to furnish the County Engineer every reasonable facility to ascertain <br />whether or not the work as performed is in accordance with the approved <br />drawings and specifications. It is understood and agreed that Inspectors <br />employed by the County shall be stationed at the work to report as to the <br />progress and performance of the work, and shall be authorized to inspect <br />any part of the work done and any material furnished, including its <br />preparation or manufacture. No sewer pipe or other appurtenance shall be <br />placed except in the presence of the County Engineer or his authorized <br />inspectors without special permission. Such inspections, however, shall <br />not relieve the Applicant from any obligation to perform all of the work <br />strictly in accordance with the Specifications. In the case of disputes <br />arising as to the materials furnished or the manner of performing the <br />work, the County Engineer shall have the authority to reject materials or <br />suspend work until the question at issue can be resolved. It is further <br />understood and agreed that the Applicant shall remove any work or <br />materials condemned as unsatisfactory by the County Engineer and shall <br />rebuild and replace same to the standard required by the specifications, <br />all at his own expense and in default thereof, the same may be done by <br />the County and the cost charged against the Applicant. Final connection <br />to the County's sanitary sewerage system will not be permitted until all <br />work has been approved by the County Engineer and any applicable fees or <br />charges paid. <br /> <br />It is understood and agreed that the Applicant and other parties may <br />discharge sewage into the proposed line or lines only under and in <br />accordance with the standard rules and regulations of the County Sewer <br />Use Policy. Such obligation shall include the applicant providing the <br />County with the name and address of each user of the sewer system and <br />informing any such users of the obligation of all usual fees and charges <br />including security deposits and monthly user fees. Fees collected shall <br />be paid directly to the County by the individual users of the system. <br /> <br />Any connections, additions, or extensions to the herein described sani- <br />tary sewer lines shall be made only upon written permission of the <br />County. Such connections, addition, or extensions of the herein de- <br />scribed sewer facilities shall not be subject to any tap-on or privilege <br />fees unless otherwise stated in this contract. <br /> <br />The applicant upon completion of all the described work shall request a <br />final inspection and testing of the project from the County Engineer. <br />The inspection will be scheduled within thirty (30) days of the date of <br />the request. The applicants request should be in writing along with a <br />statement from the applicants engineer that the project is complete and <br />according to approved plans and specifications. <br /> <br />The applicant agrees to guarantee all materials and labor associated with <br />the project for a period of one (1) year after the date of formal written <br />acceptance from the County. The applicant also agrees to be responsible <br />for any cost of warranty repairs that may have to be made using County <br />forces during emergency situations. <br /> <br /> <br />
