After completion of all construction and final inspections, the Applicant's engineer shall prepare and furnish to the county reproducible drawings of all construction plans revised to show any and all revisions encountered during construction. The drawings shall be marked "AS-BUILT" and show the actual condition in which the facility was physically constructed. Further the final plans shall show the correct location of the facility as it relates to easements, right-of-way lines, roadways, railroads, and all other physical features that would have any effect or influence upon the operation or maintenance of the constructed facility. 11. It is understood and agreed that when the described sewer system is completed to the satisfaction of the County Engineer and letter of acceptance is issued that the system will automatically become the property of Cabarrus County without cost to the County or further agree- ment in connection therewith. 12. The Applicant having constructed the system at his own proper cost and expense and outside the County's standard policy for sewer extensions, agrees to waive all claims for compensation for monies refundable for any capital facilities constructed. 13. INDEMNIFICATION OF THE COUNTY. The Applicant and the applicant's con- tractor will indemnify, hold harmless, and keep harmless, the County and its agents and employees from and against all claims, damages, losses and expenses including attorney's fees arising out of or resulting from the performance of the work, provided that any such claim, damage, loss or expense is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property including the loss of use resulting therefrom, and is caused in whole or in part by any negli- gent or willful act or omission of the Applicant, the Applicant's con- tractor and subcontractors, or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. In any and all claims against the County or any of its agents or employees, by any employee of the Applicant, the Applicant's contractor or. subcontractors, or anyone directly or indirectly employed by any of them, or anyone for whose acts any of them may be liable, the indemnifi- cation obligation shall not be limited in any way by any limitation on the amount or type of damages, compensation or benefits payable by or for the Applicant, the Applicants contractor or subcontractors under Workmen's Compensation Acts, Disability Benefit Acts or other employee benefit acts. 14. The applicant shall agree to employ only those contractors which maintain insurance coverage that meet or exceed those listed in the general conditions of the specifications. 15. Cabarrus County shall apply for all necessary permits to construct the project. The applicant agrees that any work done prior to all permits being in hand is solely at his own risk. In no case shall the system be put in operation until all permits have been obtained by the County. If any fees or costs are necessary in obtaining such permits, the applicant agrees to pay said fees at the direction of the County Engineer.
