271 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />January 18, 1988, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The meeting was called to order by Vice-Chairman Payne in the absence of <br />Chairman Lentz. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with <br />Commissioners Melvin, Moss, and Payne voting for, the minutes of December 21, <br />1987, were approved as written. <br /> Chairman Lentz and Commissioner Hamby arrived and were present for the <br />remainder of the meeting. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, and <br />Mr. James F. Owens, Planning Director, presented the proposed Zoning Text <br />amendment as approved by the Planning Board. <br /> <br />ZONING TEXT AMENDMENT <br /> <br />(1) <br /> <br />Petition 87-19. Staff Request. Amend Section 3.9 pages 19-51. Amend <br />Section 3.9 to read as shown on sheets attached. The Planning Board <br />voted unanimously to approve this petition. <br /> <br /> Chairman Lentz stated this was the day and hour for a public hearing on <br />the proposed Text amendment and asked if anyone were present who wished to <br />speak regarding the amendment. There was no present to speak for or against <br />the proposed amendment, and the public hearing was closed. <br /> UPON MOTION of Commissioner Payne, seconded by Commissi6ner Hamby and <br />unanimously carried, the Board approved Petition 87-19 to amend Section 3.9 <br />pages 19-51 to read as follows. <br /> <br />3.9 Planned Unit Developments <br /> <br />3.9-1 Reserved: <br /> <br />3.9-2 Purpose and Intent: Planned unit developments, as defined in this <br />section, are recognized as being desirable in the county in order that the <br />public health, safety, and general welfare be furthered in an era of <br />increasing urbanization and of growing demand for housing of all types and <br />design; to provide for necessary commercial, appropriate light industrial and <br />educational facilities conveniently located to such housing and to other <br />areas of the community which require such facilities; to encourage <br />innovations in residential, commercial, and light industrial development so <br />that the growing demands of the population may be met by greater variety in <br />type, design and layout of buildings and by the conservation and more <br />efficient use of open space, and so that greater opportunities for better <br />housing and recreation and shops, conveniently located to each other, may <br />extend to all citizens and residents of the town; to encourage a more <br />efficient use of land and of public services, or private services in lieu <br />thereof, and to reflect changes in the technology of land development so that <br />resulting economies may inure to the benefit of those who need homes, to <br />lessen the burden of traffic on streets and highways; to encourage the <br />building of new developments incorporating the best features of modern <br />design; to conserve the value of land; and, in aid of these purposes, to <br />provide a procedure which can relate the type, design and layout of <br />residential, commercial, and light industrial development to the particular <br />site and the particular demand for housing and other facilities, including <br />the foregoing, at the time of development in a manner consistent with the <br />preservation of the property values within established residential areas, and <br />to insure that the increased flexibility of substantive regulations over land <br />development authorized herein is subject to such administrative standards and <br />procedures as shall encourage the disposition of proposals for land develop- <br />ment without undue delay. <br /> <br />3.9-3 Area Requirements; Uses~ Density Regulations: <br /> <br />A.
