309 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />March 21, 1988, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The invocation was given by Commissioner Melvin. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the minutes of February 29 and March 14, 1988, were <br />approved as written. <br /> At 7:00 P.M., Chairman Lentz opened the public hearing for the proposed <br />Zoning Text amendment. <br /> Mr. Ronald Page, Vice-Chairman of the Cabarrus County Planning Board, <br />presented the proposed Zoning Text Amendment as recommended by the Planning <br />Board. Public input was received on the proposed amendment prior to action <br />by the Board of County Commissioners. <br /> <br />ZONING TEXT AMENDMENT <br />(1) Petition 88-04. Staff Request, Section 3.12, Watershed Overlay (WSO) <br /> District. Planning Board voted unanimously to approve this petition. <br /> The petition is as follows. <br /> <br />3.12-1 Watershed Overlay (WSO) District: It is the intent of the <br />Watershed Overlay (WSO) District to protect property within watershed <br />areas of the county from encroachment by developments. <br /> <br />3.12-2 Ail lots in the following watersheds: (1) Coddle Creek <br /> (2) Dutch Buffalo Creek <br /> (3) Coldwater Creek <br /> <br />Shall meet the following requirements: <br /> (1) Ail lots within ~ mile of the high water mark for the reser- <br /> voir shall have a minimum square footage of 80,000 square feet <br /> when served by individual wells and septic tanks. <br /> (2) All lots in the remaining area of drainage basin for the <br /> reservoirs shall have a minimum square footage of 40,000 <br /> square feet or meet requirements of the Cabarrus County Zoning <br /> Ordinance, whichever is more stringent, when served by indi- <br /> vidual wells or septic tanks. <br /> (3) Ail lots served by municipal sewer shall meet the requirements <br /> of the Cabarrus County Zoning Ordinance. <br /> <br />3.12-3 In addition, the following requirements shall apply to property <br />within ~ mile of the high water mark for the reservoir: <br /> (1) No commercial or industrial development shall be permitted. <br /> (2) All new developments shall be limited to 6% impervious <br /> coverage. <br /> (3) A 100 foot vegetative buffer shall be maintained in its <br /> natural state on all property adjoining the reservoir, no <br /> permanent structures shall be allowed in this buffer area. <br /> (4) No industrial or commercial hazardous material shall be used <br /> or stored in this ~ mile area. <br /> (5) For all new developments, plans submitted for approval shall <br /> include detention of the first ~ inch of runoff. <br /> <br />3.12-4 For the remaining watershed areas, the following requirements <br />shall be met: <br /> (1) For all new developments, plans submitted for approval shall <br /> include detention of the first ~ inch of runoff. <br /> (2) A 50 foot vegetative buffer shall be maintained adjacent to <br /> all perennial streams. <br /> <br />All proposed developments in the designated watersheds shall meet these <br />requirements. <br /> <br /> <br />
