490 <br /> <br /> WHEREAS, the Board of County Commissioners desires to approve the <br />issuance of revenue bonds and approve the Project in principle; NOW, <br />THEREFORE, <br /> <br /> BE IT RESOLVED by the Board of County Commissioners of the County of <br />Cabarrus as follows: <br /> <br /> (1) The issuance of revenue bonds by the Authority in an aggregate <br />principal amount of up to $3,500,000 to finance the Project is hereby <br />approved. <br /> (2) The Project is hereby approved in principle. <br /> (3) The Clerk of the Board of Commissioners is hereby authorized <br />and directed to provide a certified copy of this resolution to the <br />Department. <br /> (4) The Board of County Commissioners hereby requests that the <br />State of North Carolina, pursuant to Executive Order 37 of James G. <br />Martin, Governor of the State of North Carolina and Chapter 588 of the <br />Session Laws of 1987 or any other executive order or legislation relat- <br />ing to volume limitations on tax-exempt financing, allocate to the above <br />described revenue bonds and Project $3,500,000 of "unified volume <br />limitation" (as described in said Executive Order or in any such other <br />executive order or legislation), and acknowledges that any such <br />allocation shall be only for purposes of said Project and that any <br />portion of such allocation not utilized in connection with such bonds <br />and Project or which terminates or expires will, without further action, <br />revert to the State of North Carolina, and there is hereby approved the <br />application by the Authority for such an allocation. <br /> (5) This resolution shall take effect i~ediately upon its <br />passage. <br /> <br /> Commissioner Hamby moved the passage of the foregoing resolution and <br />Commissioner Moss seconded the motion, and the resolution was passed by the <br />following vote: <br /> <br />AYES: Commissioners Hamby, Moss, Melvin, and Payne and Chairman Lentz <br />NAYS: None <br /> <br /> Dr. Joseph N. Fries, Cabarrus County Schools Superintendent, reported <br />that the Council of State had transferred 49.892 acres of land from the <br />Jackson Training School Property to the Cabarrus County Board of Education to <br />be used for the location of a new middle school to serve the Central Cabarrus <br />High School District. He further stated that in order to complete the <br />acquisition of land necessary for the school site, the Schools must purchase <br />an additional 4.89 acres of land. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board approved the purchase price of $50,530.12 for <br />the purchase of property belonging to Max H. Smith, Jr., Melanie G. Smith, <br />Deleslie L. Smith and/or Peggy H. Smith by the Cabarrus County Board of <br />Education in accordance with the provisions of the purchase contract. <br /> Mr. James Tourville, Cabarrus County Fire Marshal, presented the pro- <br />posed Fire Code Permits System and outlined the basic requirements of the <br />system. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and <br />unanimously carried, the Board tabled consideration of the proposed Fire Code <br />Permits System until the regular meeting on October 3, 1988. <br /> The Board reviewed the plans for the sale of a portion of the Ambulance <br />Service Substation property to the State of North Carolina. Mr. Ben Mabrey, <br />Emergency Services Director, reported that he had been informed by Mr. <br />Franklin Brewer of the North Carolina Department of Transportation that the <br />County would not be charged rent on the substation as long as the County <br />occupies it. However, he advised the Board that the State did reserve the <br />right to give the County 45 days written notice to vacate the property if <br />Federal funds should come in for the road project. The Board indicated that <br />the sale of the property would not be finalized until a letter is received <br />from the State regarding the rental of the property. Also, the Board <br />reviewed the request from Mr. Tom Joyner to purchase property at the <br />Ambulance Substation site from the County to provide a right-of-way from his <br />property to Highway 49. No action was taken in this matter. <br /> <br /> <br />
