<br /> The Board of Commissioners for the County of Cabarrus met in regular
<br />session at the County Courthouse in Concord, North Carolina, on Monday,
<br />October 24, 1988, at 5:30 P.M. The meeting had been postponed from 4:00
<br />P.M. on that date.
<br /> Present - Chairman: James W. Lentz
<br /> Commissioners: Kenneth F. Payne
<br /> William G. Hamby, Jr.
<br /> Martha H. Melvin
<br /> R. Giles Moss
<br /> Members of the Concord Board of Aldermen present for the meeting were
<br />as follows: Mayor Bernie A. Edwards and Aldermen Frank A. Dusch, Jr.;
<br />Robert L. Mathis, Jr.; T. Laine Harling; Lamar Barrier; and Dr. Hector H.
<br />Henry.
<br /> At the hour of 5:30 o'clock p.m., Mr. James W. Lentz, Chairman of the
<br />Board of Commissioners for the County of Cabarrus, announced, pursuant to a
<br />notice duly posted and published, that this was the date and hour fixed by
<br />the Chairman of the Board of Commissioners for the County of Cabarrus, the
<br />Mayor of the City of Concord, and the Secretary of the Department of Human
<br />Resources of the State of North Carolina for the joint public hearing upon a
<br />petition filed with the Board of Cox~issioners for the County of Cabarrus on
<br />February 15, 1988, requesting that the South Concord Sanitary District in
<br />Cabarrus County, North Carolina, be dissolved. The Chairman of the Board of
<br />Commissioners announced that the Board of Commissioners for Cabarrus County,
<br />North Carolina, the Board of Aldermen for the City of Concord, and the
<br />representative of the Secretary of the North Carolina Department of Human
<br />Resources would immediately hear any and all freeholders resident within the
<br />South Concord Sanitary District and any other interested persons concerning
<br />the dissolution of said sanitary district.
<br /> Mr. B. S. Brown, Jr., attorney representing members of the Board of
<br />South Concord Sanitary District, reviewed the history of the South Concord
<br />Sanitary District and stated that said sanitary district now lies within the
<br />corporate limits of the City of Concord, that the district has no outstand-
<br />ing indebtedness, and that the district presently does not provide service
<br />to anyone since the services formerly provided by the sanitary district are
<br />now being provided by the City of Concord. Mr. Brown further stated that
<br />the petition requesting dissolution was signed by approximately 98 per cent
<br />of the resident freeholders of the sanitary district and that he knows of no
<br />opposition to the dissolution. Mr. Brown introduced to the Board Mr. Guy
<br />Moose and Mr. H. S. Connell, members of the Sanitary District Board of South
<br />Concord Sanitary District who indicated that they favored the dissolution of
<br />the sanitary district.
<br /> Mr. Wade B. MacDonald, Jr., representative of the Secretary of the
<br />North Carolina Department of Human Resources, was recognized. On inquiry,
<br />Mr. MacDonald determined that the South Concord Sanitary District lies
<br />within the corporate limits of the City of Concord and that the annexation
<br />which covered the territory of the South Concord Sanitary District is now
<br />effective.
<br /> No freeholder resident within the South Concord Sanitary District or
<br />other interested person appeared, either in person or by attorney, to
<br />protest against the dissolution of the South Concord Sanitary District, and
<br />no protest in writing, signed by any resident freeholder or interested
<br />person, has been presented.
<br /> Thereupon, Commissioner Kenneth F. Payne introduced the following
<br />resolution which was read:

<br />RESOLUTION CONCERNING DISSOLUTION
<br />OF SOUTH CONCORD SANITARY DISTRICT
<br />IN CABARRUS COUNTY, NORTH CAROLINA
<br />
<br /> WHEREAS, a petition proposing the dissolution of the South Concord
<br />Sanitary District in Cabarrus County, North Carolina, was filed with the
<br />Board of Commissioners for the County of Cabarrus on February 15, 1988,
<br />which petition is set forth in the minutes of the February 15, 1988 meeting
<br />of said Board, such minutes being recorded in Volume 20, beginning at page
<br />292 and ending at page 294; and
<br /> WHEREAS, it appears that the reason for the dissolution of said
<br />sanitary district is that it lies totally within areas which have been
<br />annexed to and become a part of the City of Concord, and the services
<br />
