519 <br /> <br /> BE IT RESOLVED by the Board of Commissioners for the County of <br />Cabarrus: <br /> <br /> Section 1. That a resolution passed by the Board of Commissioners for <br />the County of Cabarrus after a public hearing held jointly with the Mayor <br />and Board of Aldermen of the City of Concord and a representative of the <br />Secretary of the Department of Human Resources of the State of North <br />Carolina on October 24, 1988, which resolution is in the following words and <br />figures, be and the same is hereby approved, ratified and confirmed: <br /> <br />"RESOLUTION CONCERNING DISSOLUTION OF SOUTH CONCORD SANITARY DISTRICT <br /> IN CABARRUS COUNTY, NORTH CAROLINA" <br /> <br /> WHEREAS, a petition proposing the dissolution of the South Concord <br />Sanitary District in Cabarrus County, North Carolina, was filed with the <br />Board of Commissioners for the County of Cabarrus on February 15, 1988, <br />which petition is set forth in the minutes of the February 15, 1988 meeting <br />of said Board, such minutes being recorded in Volume 20, beginning at page <br />292 and ending at page 294; and <br /> <br /> WHEREAS, it appears that the reason for the dissolution of said sani- <br />tary district is that it lies totally within areas which have been annexed <br />to and become a part of the City of Concord, and the services rendered by <br />the sanitary district have been assumed and are now rendered by the City of <br />Concord; and <br /> <br /> WHEREAS, it appears that the sanitary district owes no debts, that said <br />sanitary district has never levied a tax, and that the majority of persons <br />who were served by the sanitary district are in favor of dissolution of the <br />sanitary district; and <br /> <br /> WHEREAS, a public hearing has been duly held in accordance with the <br />requirements of the North Carolina General Statutes; now, therefore, <br /> <br /> BE IT RESOLVED by the Board of Commissioners for the County of <br />Cabarrus: <br /> <br /> Section 1. That the Board of Commissioners deems it advisable to <br />comply with the request of said above-mentioned petition for the dissolution <br />of the South Concord Sanitary District in Cabarrus County, North Carolina, <br />and does hereby determine that such sanitary district, for the reasons <br />stated in the petition, should be dissolved pursuant to Chapter 130A of the <br />General Statutes of North Carolina. <br /> <br /> Section 2. That the Clerk of the Board of Commissioners is hereby <br />directed to certify immediately a copy of this resolution to the Board of <br />Aldermen of the City of Concord and to the Secretary of the Department of <br />Human Resources of the State of North Carolina." <br /> <br /> Section 2. That the Clerk of the Board of Commissioners is hereby <br />directed to certify immediately a copy of this resolution to the Secretary <br />of the Department of Human Resources of the State of North Carolina. <br /> <br /> Commissioner Payne moved the passage of the foregoing resolution <br />entitled "RESOLUTION APPROVING, RATIFYING AND CONFIRMING A RESOLUTION PASSED <br />BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF CABARRUS ENTITLED: 'RESOLU- <br />TION CONCERNING DISSOLUTION OF SOUTH CONCORD SANITARY DISTRICT IN CABARRUS <br />COUNTY, NORTH CAROLINA'", and Commissioner Moss seconded the motion, and the <br />resolution was passed by the following vote: <br /> <br />Ayes: Commissioners Payne, Moss, and Melvin and Chairman Lentz <br />Noes: None <br /> <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and <br />unanimously carried, the Board designated Chairman Lentz as the voting <br />delegate for Cabarrus County at the North Carolina Association of County <br />Commissioners Legislative Goals Conference to be held at the Sheraton <br />Imperial in Research Triangle Park, North Carolina, on December 8-9, 1988. <br /> <br /> <br />
