UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board moved to go into Executive Session to <br />discuss a legal matter with the County Attorney regarding the letter <br />submitted by Mr. Jim Simpson. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Simmons <br />and unanimously carried, the Executive Session was terminated. <br /> Upon questioning by Mr. Fletcher L. Hartsell, Jr., County Attorney, <br />Mr. Jim Simpson acknowledged the following issues: <br /> <br />(1) The Planned Unit Development requires municipal water and sewer <br /> services and there is no commitment from the County at this time <br /> to provide those facilities. <br />(2) Another hearing will be required for the approval of any <br /> conditional or special uses for the development. <br />(3) No building permits can be issued until the development plans <br /> have been completed and the water and sewer issue has been <br /> resolved. <br /> <br /> Chairman Lentz closed the public hearing on Petition 88-03 by CSD & <br />Associates at 8:40 P.M. <br /> UPON MOTION of Commissioner Simmons, seconded by Commissioner Melvin <br />and unanimously carried, the Board approved Petition 88-03 as amended by <br />the Kings Grant project developers to rezone property on 1-85 at the <br />Mecklenburg County line, Map/PIN 4589-65-8898, 4599-10-2657, 4599-12-3170, <br />from ARR/A-I to Planned Unit Development with the exclusion of Tract A <br />described as follows: <br /> <br />The 347.3 acre tract generally known as the Northwest quadrant and <br />bounded by Rocky River on the south and Interstate 85 on the east, <br /> <br /> There being no further business to come before the Board, the meeting <br />was adjourned at 8:45 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
