58 <br /> <br /> HHS <br /> CONTRACT AMENDMENT <br />STATE OF NORTH CAROLINA WEATHERIZATION ASSISTANCE PROGRAM <br />COUNTY OF WAKE FOR LOW-INCOME PERSONS <br /> <br />ENERGY DIVISION CONTRACT NUMBER 88-4424-50A1 <br />NORTH CAROLINA DEPARTMENT <br />OF COMMERCE <br /> <br /> Pursuant to Part II, paragraph two of the Weatherization Assistance <br />Plan Agreement (hereinafter referred to as agreement), dated <br />between the Energy Division, North Carolina Department of Commerce and <br />Cabarrus County Department of Aging, the following amendment is hereby <br />set forth: <br /> <br /> PART I, Section 3: Period of Performance. The Contractor shall <br />commence performance of this amendment on the day of , <br />and shall complete the program with all practicable dispatch in a sound, <br />economical, and efficient manner to the satisfaction of the Grantee no <br />later than the 30th day of June, 1989. <br /> <br /> PART I, Section 4: Cost of Program. In order to assist the <br />Contractor in financing the cost of the Program, the Grantee will pay <br />the Contractor an amount not to exceed the following: <br /> <br />Administration <br />Program Support <br />Materials <br />Total Award <br /> <br />Present Contract Amendment <br />$ 1,086.00 240.00 <br />10,208.00 2,256.00 <br />6,806.00 1,504.00 <br />18,100.00 4,000.00 <br /> <br />Total Contract <br /> <br />$ 1,326.00 <br />12,464.00 <br />8,310.00 <br />22,100.00 <br /> <br />These funds shall be drawn down monthly based on actual expenditures. <br />In no event shall expenditures exceed the total authorized budget. <br /> <br /> Budget line item expenditures must conform with the approved budget <br />as outlined above. During the contract period, a Request for Budget <br />Revision (line item transfer) must be submitted for approval by the <br />grantee prior to any line item overage. Minor line item adjustments <br />necessary to reconcile the budget with final actual expenditures may be <br />initiated without prior approval within 45 days of contract termination. <br />However, in no event shall administrative expenditures exceed the 6% <br />maximum available for administrative costs. Further, no less than 40% <br />of total contract expenditures, less administration and liability <br />insurance must be for materials installed on units required under this <br />contract. <br /> <br /> PART III, Section 6: Schedule of Implementation The Contractor <br />agrees that a minimum of 16 dwelling units are to be weatherized during <br />the grant period defined in Part 1, Section 3. In addition, the <br />Contractor agrees that if the rate of completion of weatherized units <br />falls to a level that will prevent the Contractor from utilizing the <br />full amount of funds provided under this contract, then the Contractor <br />will notify the Grantee of such a situation and allow the renegotiation <br />of the contract to a funding level consistent with the contractor's <br />current rate of production. In the event that the Contractor receives <br />an approved Average Cost Waiver from the Grantee, the minimum unit <br />requirement shall be adjusted accordingly. <br /> <br /> Ail parts of the basic contract (as previously amended) not <br />specifically changed by the amendment shall remain valid and enforceable <br />against both parties. <br /> <br /> This form shall serve as a valid amendment to the original <br />agreement and shall be effective upon execution by both parties. <br /> <br /> BY: <br /> <br /> Date: <br />ATTEST: /s/ Frankie F.
