<br /> The Board of Commissioners for the County of Cabarrus met in regular
<br />session at the County Courthouse in Concord, North Carolina on Monday, June 19,
<br />1989, at 7:00 P.M.
<br /> Present - Chairman: James W. Lentz
<br /> Commissioners: R. Giles Moss
<br /> William G. Hamby, Jr.
<br /> Martha H. Melvin
<br /> Billy J. Simmons, Jr.
<br /> The invocation was given by Reverend Lonnie L. Darnell, II, of the Second
<br />Presbyterian Church in Kannapolis, North Carolina.
<br /> Commissioner Simmons was absent for the beginning of the meeting.
<br /> UPON MOTION of Commissioner Melvin, seconded by Chairman Lentz with
<br />Commissioners Melvin, Moss, and Hamby and Chairman Lentz voting for, the minutes
<br />of June 1 and June 5, 1989 were approved as written.
<br /> Chairman Lentz stated that this was the date and hour for a public hearing
<br />regarding a proposed Zoning Atlas amendment. Mr. Jonathan Marshall, member of
<br />the County Planning Staff, reviewed the location of the area proposed for
<br />rezoning and presented the staff findings. Public input was received prior to
<br />action by the Board.

<br />ZONING ATLAS AMENDMENTS

<br />Petition 89-06. Roger Franklin, petitioner, 891 Central Drive and Porter
<br />Street, Township 4, Map/PIN 5611-84-7063. Wishes to rezone from R-15 to
<br />C-3. Planning Board voted 5-0 to approve this petition.
<br />
<br /> Mr. Roger Franklin, petitioner, informed the Board that appropriate
<br />screening has been provided on the property.
<br /> There was no one present to speak against the petition, and the public
<br />hearing on Petition 89-06 was closed.
<br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby with
<br />Commissioners Moss, Hamby, and Melvin and Chairman Lentz voting for, the Board
<br />approved Petition 89-06 by Roger Franklin to rezone Map/PIN 5611-84-7063 from
<br />R-15 to C-3.
<br /> Mr. James F. Owens, Planning Director, and Mr. Robert Stark, Consultant,
<br />briefly reviewed the Community Development Block Grant project recently completed
<br />in the Highway 73 West Community.
<br /> Chairman Lentz stated that this was the day and hour for a close-out public
<br />hearing for the Highway 73 West Community Development Block Grant project and
<br />asked if anyone were present who wished to speak concerning this project. There
<br />was no one present to address the Board, and Chairman Lentz closed the public
<br />hearing.
<br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with
<br />Commissioners Melvin, Moss, and Hamby and Chairman Lentz voting for, the Board
<br />approved the renewal of the Lease for the Old Cabarrus County Courthouse between
<br />Historic Cabarrus, Inc. and Cabarrus County for an additional term of four years
<br />to begin at the end of the current term and to expire on September 30, 1993.
<br />The Lease as authorized for execution by the Board is as follows.

<br /> THIS LEASE, made and entered into this the day of ,
<br />1989, by and between the BOARD OF COUNTY COMMISSIONERS of Cabarrus County, North
<br />Carolina, a body corporate and politic, hereinafter called "the County" or
<br />"Cabarrus County", and HISTORIC CABARRUS, INC., a non-profit corporation
<br />organized and existing under the laws of the State of North Carolina having its
<br />principal office in the City of Concord, Cabarrus County, North Carolina,
<br />hereinafter called "Historic Cabarrus";
<br />
<br />W I T N E S S E T H : that --
<br />
<br /> WHEREAS, the County has determined that the property hereinafter described,
<br />known as the "Old Cabarrus County Courthouse", will not be needed by the County
<br />for the term of this lease and the renewal term; and that it is in the best
<br />interest of the County to enter into this Lease Agreement.
<br /> NOW, THEREFORE, IN CONSIDERATION OF THE PREMISES AND OF THE AGREEMENTS
<br />HEREINAFTER SET OUT TO BE DONE AND PERFORMED BY HISTORIC CABARRUS, the County
<br />does hereby demise and lease unto Historic Cabarrus the following described
<br />property:
