136 <br /> <br /> Lying and being in Ward No. 3 of the City of Concord, North <br />Carolina, on the east side of South Union Street and on the south <br />side of Means Avenue and being the lot upon which the old Cabarrus <br />County Courthouse is located and described as follows: <br /> <br /> BEGINNING at a point in the southeast intersection of South <br />Union Street and Means Avenue and running thence with Means Avenue <br />in an easterly direction to a point; thence in a southerly direction <br />parallel with and 40 feet from the rear wall of the old Cabarrus <br />County Courthouse to a point; thence in a westerly direction along <br />a line midway between the south wall of the old Cabarrus County <br />Courthouse and the edge of the bottom step on the north side of the <br />new Cabarrus County Courthouse to a point in the east edge of South <br />Union Street; thence with South Union Street in a northerly <br />direction to the BEGINNING. <br /> <br /> To have and to hold said lands and premises, together with all privileges <br />and appurtenances thereunto belonging to Historic Cabarrus, its successors and <br />assigns, for the term and upon the conditions hereinafter set forth: <br /> <br /> 1. That this Lease shall commence as of the date hereof and shall exist <br />and continue to and including the 30th day of September, 1993; provided, however <br />that Historic Cabarrus may, at its option and for the uses and purposes <br />aforesaid, extend the term of this Lease for an additional period of four (4) <br />years by notifying the County in writing at least ninety (90) days prior to the <br />date of the termination of this Lease. <br /> 2. In lieu of the payment of rent, Historic Cabarrus will accept the old <br />Cabarrus County Courthouse in its present condition and will: <br /> (a) secure it from damage by the elements and other hazards; <br /> (b) repair and paint the stucco and woodwork on the outside of the <br /> building and replace so much of the woodwork as may be <br /> damaged; <br /> (c) repair and restore the interior of the building to a condition <br /> as much like its original conditions as possible; provided, <br /> however, that central heating, air conditioning, electrical <br /> fixtures and appliances may be utilized in such ways as not <br /> to detract from the original appearance of the building and <br /> may make such additional improvements as shall contribute to <br /> the beauty of said building as it originally existed, all of <br /> which shall be done upon the advice and under the supervision <br /> of a competent architect and according to a general plan of <br /> restoration; and <br /> (d) maintain said building and the grounds covered by this <br /> lease in a good state of repair. <br /> 3. Historic Cabarrus will purchase and keep in force liability <br />insurance in such amounts and against such hazards as may be necessary or <br />desirable and will insure said building against fire and windstorm for the use <br />and benefit of Historic Cabarrus or its contributors as their interests appear. <br /> 4. If the building upon the demised premises shall be damaged by fire <br />or other casualty, and such damages are of a minor nature, the same shall be <br />repaired by Historic Cabarrus as quickly as is reasonably possible; but if said <br />building shall be damaged to such an extent as to render the same unfit for uses <br />or occupancy, this Lease shall terminate as of the date of such damage. <br /> 5. Historic Gabarrus shall be responsible for the payment of all bills <br />for water, heating and electrical current, and the occupants of the building <br />shall be responsible for the payment of their own respective telephone bills. <br /> 6. Historic Cabarrus shall have the right to sublet any parts of the <br />Old Cabarrus County Courthouse to such organizations as it may desire subject <br />to the terms of this Lease; provided, however, that Historic Gabarrus and its <br />under tenants shall make no unlawful or offensive use of the premises. Historic <br />Cabarrus hereby warrants that it will not arbitrarily restrict the use of said <br />premises and, subject to its use of the building and the agreements Historic <br />Cabarrus enters into with any sub-lessee, will make the building available for <br />bona fide public uses. <br /> 7. If Historic Cabarrus shall not be diligent in its solicitation of <br /> funds and shall fail to pursue its work in the restoration of the Old Cabarrus <br /> County Courthouse in an orderly manner or shall fail to pay the costs of <br /> improvements as agreed upon without just cause or excuse for a period of ninety <br /> <br /> <br />
