156 <br /> <br />CONTRACT TO PROVIDE TAX DISTRICT FIRE SERVICE <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />This contract, made and entered into this day of , <br />19__, by and between the Volunteer Fire Department <br />Inc., a nonprofit corporation, and the County of Cabarrus; <br /> WITNESSETH: <br />That for and in consideration of the mutual covenants hereinafter <br />contained, and pursuant to authority granted by G.S. 69-25.5, G.S. <br />69-25.6, and G.S. 153A-233, the Volunteer Fire <br />Department and the County of Cabarrus do hereby covenant and agree <br />as follows: <br /> 1. The County of Cabarrus agrees to annually levy and collect <br />upon all taxable property lying within the Cabarrus County <br />boundaries of the Volunteer Rural Fire Protection Tax <br />District an ad valorem property tax equal to cents per one <br />hundred ($100.00) valuation, and after deduction of the County's <br />administrative charge (5%) for collection of such taxes, to pay the <br />same to the Volunteer Fire Department Inc. Ail monies <br />collected will be paid to the fire department regardless of actual <br />dollars budgeted. <br /> An additional supplement in the sum of $250.00 per month shall <br />be payable as specified in the Cabarrus County Fire Protection <br />Resolution. <br /> 2. The Volunteer Fire Department agrees to furnish <br />and provide continuing fire protection service to all property lying <br />within the boundaries of the Volunteer Rural Fire <br />Protection Tax District by dispatching upon call any or all of its <br />equipment and adequate personnel to operate same. <br /> 3. The Tax Collector of the County of Cabarrus shall collect <br />the ad valorem taxes so levied and shall make payment of the same <br />to the Volunteer Fire Department monthly as collections <br />are made. <br /> 4. The Volunteer Fire Department agrees to <br />operate within the guidelines set forth in the Cabarrus County Fire <br />Protection Resolution attached to this contract. <br /> 5. This contract may be terminated by either party at the end <br />of any fiscal year by giving 90 days written notice of its intent <br />to so terminate to the other party. <br /> In witness whereof the Volunteer Fire <br />Department, Inc. has caused these presents to be signed by its <br />President and attested to by its Chief, and the County of Cabarrus <br />has caused these presents to be signed by its Chairman and attested <br />by the Clerk of its Board of Commissioners. <br /> This the day of , 19__. <br /> <br />Fire Department, Inc. <br /> <br />Attest: President <br /> <br />Chief <br /> <br />County of Cabarrus <br /> <br />Attest: Chairman <br /> <br />Clerk <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board approved the following Proposal for Engineering <br />Services as submitted by W. E.
