163 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina on Monday, July 24, <br />1989, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Absent - Commissioner: William G. Hamby, Jr. <br /> Commissioner Simmons was absent for the beginning of the meeting and <br />arrived during the executive session. <br /> The invocation was given by Reverend Gary Howell of the Independence Square <br />Free Will Baptist Church. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with <br />Commissioners Melvin and Moss and Chairman Lentz voting for, the minutes of June <br />19 and 29, 1989 were approved as written. <br /> At 7:00 P.M., Chairman Lentz stated that this was the date and hour <br />scheduled for a public hearing on the proposed Zoning Atlas and Text amendments. <br /> Ms. Nancy Randall, member of the Cabarrus County Planning Board, presented <br />each of the proposed Zoning Atlas and Text amendments as recommended by the <br />Planning Board. Mr. Jonathan Marshall, member of the Planning Department staff, <br />reviewed the location of each area proposed for rezoning. Public input was <br />received prior to action by the Board. <br /> <br />ZONING ATLAS AMENDMENTS <br />(1) PETITION 89-08. <br /> <br /> Bennie Ruth Hunsucker, U.S. 601 south of Flowes <br />Store/Miami Church Roads intersection, Map/PIN 5548-09-2774. Wishes to <br />rezone from ARR to C-4. The Planning Board voted 5-0 to deny this <br />petition, but directed the Planning Staff to review all of the zoning at <br />the Miami Church Road/Flowes Store Road/U.S. 601 intersection (including <br />the property in question) to determine whether the entire area should be <br />rezoned to create a commercial node. The Board also directed Staff to <br />determine other parts of the County where this type of action might be <br />appropriate. <br /> <br /> Ms. Bennie Ruth Hunsucker, petitioner, requested approval of Petition 89- <br />08 and stated she wished to use the property for the sale and storage of rental <br />furniture and other retail items. Ms. Reba Lee, employee of Ms. Hunsucker, also <br />spoke in support of the rezoning request. <br /> There was no one present to speak against the proposed rezoning, and <br />Chairman Lentz closed the public hearing on Petition 89-08. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Moss with <br />COmmissioners Melvin and Moss and Chairman Lentz voting for, the Board approved <br />Petition 89-08 to rezone property located on U. S. 601, Map/PIN 5548-09-2774, <br />from ARR to C-4 based the following rationale: (1) The property is located on <br />a major transportation facility; (2) There are two other commercial uses and the <br />Allen Volunteer Fire Department in close proximity to the property; (3) The <br />business is the petitioner's major and principal source of income; and (4) A <br />major part of the thoroughfare is expected to become commercial in the near <br />future. <br /> <br />(2) <br /> <br />PETITION 89-09. Rowan/Cabarrus Community College. Trinity Church Road <br />near Highway 73 West, Map/PIN 5601-58-5542. Wishes to rezone from C-4/I- <br />2 to O-I. The Planning Board voted 3-2 to deny this petition, and then <br />voted 5-0 to approve the petition contingent on the Community College <br />constructing turn lanes on Trinity Church Road at the entrances to the <br />campus, and the College requesting the N.C.D.O.T. to construct turn lanes <br />on N.C. 73 at Trinity Church Road. <br /> <br /> The Board acknowledged the letter from Mr. J. D. Goins, Division Engineer <br />with the North Carolina Department of Transportation, indicating that the <br />Department will request funds to construct a left turn lane on N.C. 73 when <br />construction of Rowan-Cabarrus Community College begins. It was noted that the <br />project is subject to approval of funds by the Board of Transportation and <br />availability of right of way. <br /> There was no one present to speak for or against the proposed rezoning, <br />and Chairman Lentz closed the public hearing on Petition 89-09. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Melvin with <br />Commissioners Moss and Melvin and Chairman Lentz voting for, the Board approved <br />Petition 89-09 by Rowan/Cabarrus Community College to rezone property on Trinity <br />Church Road, Map/PIN 5601-58-5542, from C-4/I-2 to O-I as recommended by the <br />Planning Board. <br /> <br /> <br />
