Williams to the <br />Domiciliary Home Community Advisory Committee for a one-year term ending <br />December 21, 1990. <br /> Mr. Michael M. Ruffin, County Manager, reported that Mr. David Bluto had <br />asked that the Board visit property that is he wishes to develop in the <br />watershed overlay zone. The Board agreed to visit the Bluto property as well <br />as the Rocky River/Robinson Church Road area on November 20, 1989, at 4:00 P.M. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board authorized the execution of the following <br />"Agreement Relative to the Construction, Operation and Maintenance of a Water <br />Supply Reservoir and Related Matters" between the City of Kannapolis and <br />Cabarrus County and with the amendments as set forth by the County Attorney. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> AGREEMENT RELATIVE TO THE CONSTRUCTION, <br /> OPERATION AND MAINTENANCE OF A <br />WATER SUPPLY RESERVOIR AND RELATED MATTERS <br /> <br /> THIS AGREEMENT of Interlocal Cooperation, pursuant to Article 20 of <br />Chapter 160A of the General Statutes of North Carolina, made and entered into <br />this__ day of November, 1989, by and between the CITY OF KANNAPOLIS, a North <br />Carolina non-profit corporation (hereinafter referred to as "KANNAPOLIS"), and <br />CABARRUS COUNTY, a governmental entity and political subdivision of the State <br />of North Carolina (hereinafter referred to as "CABARRUS"); <br /> W I T N E S S E T H: that -- <br /> WHEREAS, KANNAPOLIS and CABARRUS agree that it is mutually beneficial for <br />CABARRUS to construct, operate and maintain a dam, lake and watershed in <br />Cabarrus County, North Carolina, on Coddle Creek of approximately 1,900 acres, <br />more or less (hereinafter referred to as the "Reservoir"), in order to provide <br />and supply an additional source of raw water for the residents of the greater <br />Cabarrus County area; and <br /> WHEREAS, on March 9, 1988, CABARRUS filed an action entitled "Cabarrus <br />County vs. Atlantic American Properties, Inc., Individually, and Atlantic <br />American Properties, Inc., and Fieldcrest Cannon, Inc., d/b/a Kannapolis Water <br />Company" ("KWC"), bearing File Number 88 CVS 311 in the Office of the Clerk of <br />Superior Court for Cabarrus County (the."Condemnation Action") whereby CABARRUS <br />sought to condemn certain real property owned by the defendants therein, more <br />particularly described in "Exhibit A"'and incorporated herein by reference (the <br />"KWC Real Property"), and used by said defendants as a part of a water delivery <br />system operated by KWC (the "KWC Water System"); and <br /> WHEREAS, upon filing the Condemnation Action, CABARRUS deposited the sum <br />of Forty-Seven Thousand Dollars ($47,000.00) (the "Deposit") with the Clerk of <br />Superior Court for Cabarrus County, North Carolina, an amount which it had <br />determined to be just compensation for the taking of the KWC Real Property; and <br /> WHEREAS, the KWC Water System includes, among other things: (a) a 2.6 <br />million gallon per day (MGD) capacity raw water pumping station along Coddle <br />Creek and its intake system (the "Existing Pump Station") located on the KWC <br />Real Property; (b) a 12-inch raw water transmission line (the "Existing Raw <br />Water Line") leading from the Existing Pump Station to Kannapolis Lake near <br /> <br /> <br />
