Agree to the conservation agreement between Cabarr_us County and the owner <br />that the Enhanced Voluntary Agricultural District cannot be revoked_ for at <br />least 10 vears. <br />Article IX (REVOCATION AND RENEWALS OF PRESERVATION AGREEMENT) <br />CURRENTLY READS <br />B: Renewal <br />Preservation Agreements shall be deemed automatically renewed for an <br />additional term of 10 years, unless either the Advisory Board or the <br />landowner gives written notice to the contrary no later than 30 days prior <br />to the termination date. <br />PROPOSED READING <br />Article IX (REVOCATION AND RENEWALS) <br />R- Ran'rwn1 <br />Properties entered into the Voluntary Agricultural District or the <br />Enhanced Voluntary Agricultural District shall be deemed automatically <br />renewed for an additional term of 10 years on July 1 of the tenth <br />anniversary year, unless either the Advisory Board or the landowner gives <br />written notice no later than 30 days prior to the termination date. <br />Notification of automatic renewal will be sent to qualifying land owners a <br />minimum of 60 days prior to the renewal date. <br />UPON MOTION of Vice Chairman Honeycutt, seconded by Commissioner Shue <br />and unanimously carried, the Board suspended its Rules of Procedures in order <br />to take action on this item. <br />UPON MOTION of Commissioner Mynatt, seconded by Vice Chairman Honeycutt <br />and unanimously carried, the Board scheduled a public hearing for the <br />proposed amendment to the Code of Ordinances regarding the Voluntary <br />Agricultural District Ordinance on March 21, 2016 at 6:30 p.m. or as soon <br />thereafter as persons may be heard. <br />County Manager - Community Meeting at Coddle Creels Reservoir Report <br />Jonathan Marshall, Deputy County Manager, advised the County received <br />input relating to the Coddle Creek Reservoir through a public meeting, survey <br />and other correspondence. He said two Board members, Grace Mynatt and Lynn <br />Shue, attended the public drop -in meeting along with staff. He stated the <br />public was polled on three questions: 1) The official name of the reservoir; <br />2) How they felt about the possibility of public recreation on the reservoir; <br />and 3) How they felt about ownership of the reservoir. <br />Commissioner Shue stated feedback he received from the public was <br />unanimously in favor of renaming the reservoir the Coddle Creek Reservoir. <br />He advised there were concerns from the public regarding ownership of the <br />reservoir. <br />Commissioner Mynatt stated feedback she received from the public was <br />similar to that of Commissioner Shue, adding the comments she received were <br />for the reservoir to remain a County -owned property. She advised there were <br />concerns regarding recreation on the reservoir and expressed her opposition <br />to recreation on the property. <br />Mr. Marshall . advised a resolution affirming the re- naming of the Coddle <br />Creek Reservoir is included with the agenda item for consideration. He also <br />discussed issues brought up in regards to the ownership of the reservoir and <br />a lack of understanding regarding the operation and maintenance agreement <br />with the Water and Sewer Authority of Cabarrus County (WSACC). He added that <br />the topic of recreation on the reservoir had the largest disparity among <br />responses, and at this point, he does not have a recommendation regarding <br />ownership and recreational use of the reservoir. <br />A discussion ensued. During discussion, Mr. Marshall responded to <br />questions from the Board. <br />County Manager - NCDOT Purchase of Right -of --Way at Winecoff Elementary School <br />Jonathan Marshall, Deputy County Manager, presented a request for the <br />NCDOT (North Carolina Department of Transportation) to purchase a right -of- <br />way at Winecoff Elementary School. He reported part of the construction and <br />widening of I -85 is reworking all the bridges at Main Street, Ridge Avenue <br />and the interchange at Highway 29 and 601. He stated, this has resulted in a <br />rerouting of Winecoff Avenue to connect with traffic circles over to Ridge <br />
