UPON MOTION of Commissioner Poole, seconded by Vice Chairman Honeycutt and unanimously carried, the Board adopted the Ordinance Amending the Cabarrus County Voluntary Agricultural District Ordinance Article VII and Article IX, Section B. Ordinance No. 2616 -04 AN ORDINANCE AMENDING THE CABARRUS COUNTY CODE OF ORDINANCES BE IT ORDAINED that the Cabarrus County Code of Ordinances is hereby amended as follows: Chapter 32 FARMLAND PRESERVATION - ARTICLE IV PROCEDURES; HEARINGS; NOTIFICATION is amended as follows: Section 32 -61 CERTIFICATION AND QUALIFICATION OF FARMLAND Existing language to be replaced with the following: In order for farmland to qualify for inclusion into the voluntary agricultural district or the enhanced voluntary agricultural district, it must be real property that: 1. Is engaged in agriculture as that word is defined in G.S. 106- 581.1.1 2. Be the subject of a conservation agreement as defined in N.C.G.S. 121- 35, between the county and the owner of such land that prohibits non- farm use or development of such land for at least ten years, except for the creation of not more than three lots that meet applicable county zoning and subdivision regulations. 3. Agree to the conservation agreement between Cabarrus County and the owner that the Enhanced Voluntary Agricultural District cannot be revoked for at least 10 years. Section 32 -65 REVOCATION AND RENEWAL OF PRESERVATION AGREEMENT Part (b) Renewal Existing language will be replaced with the following: B: Renewal Properties entered into the Voluntary Agricultural District or the Enhanced Voluntary Agricultural District shall be deemed automatically renewed for an additional term of 10 years on July 1 of the tenth anniversary year, unless either the Advisory Board or the landowner gives written notice no later than 30 days prior to the termination date. Notification of automatic renewal will be sent to qualifying land owners a minimum of 60 days prior to the renewal date. She advised, over the years, this has traditionally been single family housing rehabilitation, but after difficulty finding qualified applicants last year, Cabarrus County elected to commit our funding to a senior housing project in cooperation with Prosperity Unlimited, the city of Kannapolis and Wesley Community Development Corporation.
