March 21, 2016 (Regular Meeting) Page 26 82 <br />There was no one present to address the Board; therefore, Chairman <br />Morris closed the public hearing. <br />UPON MOTION of Commissioner Poole, seconded by Vice Chairman Honeycutt <br />and unanimously carried, the Board adopted the Ordinance Amending the <br />Cabarrus County Voluntary Agricultural District Ordinance Article VII and <br />Article IX, Section B. <br />Ordinance No. 2616 -04 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY <br />CODE OF ORDINANCES <br />BE IT ORDAINED that the Cabarrus County Code of Ordinances is hereby amended <br />as follows: <br />Chapter 32 FARMLAND PRESERVATION - ARTICLE IV PROCEDURES; HEARINGS; <br />NOTIFICATION is amended as follows: <br />Section 32 -61 CERTIFICATION AND QUALIFICATION OF FARMLAND <br />Existing language to be replaced with the following: <br />In order for farmland to qualify for inclusion into the voluntary <br />agricultural district or the enhanced voluntary agricultural district, it <br />must be real property that: <br />1. Is engaged in agriculture as that word is defined in G.S. 106- 581.1.1 <br />2. Be the subject of a conservation agreement as defined in N.C.G.S. 121- <br />35, between the county and the owner of such land that prohibits non- <br />farm use or development of such land for at least ten years, except for <br />the creation of not more than three lots that meet applicable county <br />zoning and subdivision regulations. <br />3. Agree to the conservation agreement between Cabarrus County and the <br />owner that the Enhanced Voluntary Agricultural District cannot be <br />revoked for at least 10 years. <br />Section 32 -65 REVOCATION AND RENEWAL OF PRESERVATION AGREEMENT Part (b) <br />Renewal <br />Existing language will be replaced with the following: <br />B: Renewal <br />Properties entered into the Voluntary Agricultural District or the Enhanced <br />Voluntary Agricultural District shall be deemed automatically renewed for an <br />additional term of 10 years on July 1 of the tenth anniversary year, unless <br />either the Advisory Board or the landowner gives written notice no later than <br />30 days prior to the termination date. Notification of automatic renewal <br />will be sent to qualifying land owners a minimum of 60 days prior to the <br />renewal date. <br />Adopted this the 21St day of March, 2016 by the Cabarrus County Board of <br />Commissioners. <br />/s/ Stephen M. She advised, over the years, this has traditionally been <br />single family housing rehabilitation, but after difficulty finding qualified <br />applicants last year, Cabarrus County elected to commit our funding to a <br />senior housing project in cooperation with Prosperity Unlimited, the city of <br />Kannapolis and Wesley Community Development Corporation. She proposed to <br />commit our funding to this project again in the hope it will be funded this <br />
