October 17, 2016 (Regular Meeting) Page 2926 <br />Emergency management means, broadly, to carry out the basic government <br />functions of maintaining the public peace, health and safety during an <br />emergency. This shall include plans and preparations for protection from, and <br />relief and recovery from, effects of an attack by the forces of an enemy nation <br />or the agents thereof, and it shall also include such activity in connection <br />with Temergencies It shall not, however, include any activity that is <br />the primary responsibility of the military forces of the United States. <br />Emergency management shall also mean the employees, equipment and facilities of <br />all county departments, boards, councils, institutions and commissions; and, in <br />addition, it shall include all volunteer personnel, equipment and facilities <br />contributed by, or obtained from, volunteer persons or agencies. <br />Emergency management volunteer means any person duly registered, identified <br />and appointed by the emergency management coordinator of the county and assigned <br />to participate in the integrated emergency management activities. <br />Regulations means and includes plans, programs and other emergency <br />procedures deemed essential to emergency management as made by the coordinator. <br />Volunteer means contributing a service, equipment or facilities to emergency <br />management ae�ivite atvtiviti?.-, without remuneration. <br />(Ord. of 5 -7 -84, § 3; Ord. No. 1997 -19, 10- 2C -97) <br />Cross reference — Definitions generally, § 1--2. <br />Sec. 22 -29. - Penalty for violation of article. <br />It shall be unlawful for any person to violate any of the provisions of this <br />article or of the regulations or plans issued pursuant to the authority <br />contained in this article, or to willfully obstruct, hinder or delay any member <br />of the emergency services organization in the enforcement of the provisions of <br />this article or any regulations or plan issued pursuant to this article. Any <br />person who violates any provision any ordinance or declaration enacted or <br />declared pursuant to this ordinance shall be guilty of a. Class 2 misdemeanor in <br />accordance with G.S. 14- 288.20A. <br />(Ord. of 5 -7 -84, § 9) <br />Sec. 22 -30. - organization and appointments. <br />(a) The organization shall consist of the following: <br />(1) An emergency management coordinator, and such assistants and other <br />employees as are deemed necessary. <br />(2) The employees, and resources of all county departments, boards, <br />institutions, and councils will participate in the emergency management <br />activities. Duties assigned to county departments shall be the same or <br />similar to the normal duties of the department, where possible. <br />(3) Volunteer personnel and agencies offering service to and accepted by the <br />county. <br />(b) Pursuant to G.S. 166A- X219.15 (b +—, the office of the county manager <br />shall be the emergency management agency, and the county manager shall be <br />the emergency management coordinator, responsible for the organization, <br />administration and operation of the emergency management agency, subject to <br />the direction and guidance of the county board of commissioners. <br />(c) The coordinator shall designate individuals to whom emergency management <br />duties may be delegated, subject to budget appropriations approved by the <br />board of commissioners. <br />(Ord. of 5 -7 -84, § 4; Ord. No. 1997 -19, 10- 20-97) <br />Sec. 22 -31. - Emergency powers and duties. <br />The county emergency management coordinator, or his designee(s), during any <br />period when the county has been struck by =me=an emergency may promulgate <br />such regulations as he deems necessary to protect life and property and preserve <br />critical resources after he has contacted and received approval from the county <br />board of commissioners. Such regulations may include, but shall not be limited <br />to the following: <br />(1) Regulations prohibiting or restricting the movement of vehicles in order <br />to facilitate the work of emergency management forces, or to facilitate <br />the mass movement of persons from critical areas within the county. <br />(2) Regulations pertaining to the movement of persons from areas deemed to <br />be hazardous or vulnerable to disaster. <br />
