October 17, 2016 {Regular Meeting} <br />(Ord. of 1- 15 -90, § 8) <br />Page 2931 <br />Sec. 22 -61. - Removal of prohibitions and restrictions. <br />The chairman shall, by eela on , terminate the entire <br />declaration of emergency or remove any of the prohibitions and restrictions <br />when the emergency no longer requires them, or when directed to do so by the <br />board of commissioners. <br />(Ord. of 1- 15 -90, § 9) <br />Sec. 22 -62. - Superseding and amendatory preelamati <br />The chairman, in his discretion, may invoke the restrictions authorized by <br />this article in separate 9e'a - °` enedeclarations and may amend any <br />declaration by means of a superseding p? °ez ~l ~:_ = declaration in <br />accordance with the procedures set forth in section 22 -54. <br />(Ord. of 1- I5 -90, § 10) <br />Sec. 22 -63. - Termination of p -eel a= i- F;ndeclaration <br />Any declaration issued under this article shall <br />days a-ftei= its lash i�frp s-i r trFiless seafreL only be terminated in writing <br />under the same procedures set forth in section 22 -54 for <br />(Ord. of 1- 15 -90, § 11) <br />Sec. 22 -64. - Absence or disability of chairman. <br />In case of the absence or disability of the chairman, the vice - chairman of <br />the board of commissioners, or such other person as may be designated by the <br />board of commissioners, shall have and exercise all of the powers given the <br />chairman in this article. <br />(Ord. of 1- 15 -90, § 12) <br />(G -4) Planning and Development - Proposed Amendments to the Zoning Ordinance <br />- Public Hearing 6:30 P.M. <br />Susie Morris, Planning and Zoning Manager, reported on thirteen (13) <br />proposed text amendments (TEXT2016 -00001 through TEXT2016- 00013) to comply with <br />new State and Federal regulations and to provide easier access and understanding <br />for the public. <br />A lengthy discussion ensued. During discussion, Ms. Morris responded to <br />questions from the Board. In the discussion, it was decided to table the text <br />amendment regarding bed and breakfast facilities to a later meeting. <br />Chairman Morris opened the public hearing at 7:06 p.m. The Public Hearing <br />Notice was posted on the County's website ( www.cabarrus county. us ) on October 4, <br />2016 in accordance with Article 2, Administration, Section 2.1 (Use of <br />Electronic Means to Provide Public Notices) of the Cabarrus County Code of <br />Ordinances. <br />There was no one present to address the Board; therefore, Chairman Morris <br />closed the public hearing. <br />Vice Chairman Honeycutt MOVED, to approve TEXT2016 -00001 through <br />TEXT2016- 00013 with the exception of TEXT2016- 00007, which shall be tabled until <br />a later date. Commissioner Shue seconded the motion. <br />Prior to the vote, Ms. Morris requested the motion clarify only tabling <br />the bed and breakfast portion of TEXT2016 -00007 so that Planning and Development <br />staff could move forward with the remainder of the text amendments. <br />Commissioner Mynatt amended the MOTION to approve the changes to TEXT2016- <br />00001 through TEXT2016 -00013 with the exception of the portion of Chapter 7 of <br />TEXT2016 -00007 regarding bed and breakfasts, which shall be tabled until a later <br />date. Vice Chairman Honeycutt seconded the amended motion and the MOTION <br />unanimously carried. <br />Jonathan Marshall, Deputy County Manager, requested a motion to address <br />the Code of Ordinance as presented (and discussed at the October 3, 2016 Work <br />Session). <br />
