Smit, Clerk to the Board <br /> Ordinance No. 2017-28 <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY DEVELOPMENT ORDINANCE <br /> TEXT2017-00003 <br /> BE IT ORDAINED that the Cabarrus Development Ordinance is hereby amended as <br /> follows: <br /> AMEND CHAPTER 8, CONDITIONAL USES #21 RECEPTION FACILITIES AS FOLLOWS: <br /> Reception Facilities <br /> Agricultural Open and Countryside Residential districts <br /> a. A complete description of the facility including but not limited to: <br /> 1. Types of events <br /> 2. Days and hours of operation <br /> 3. Projected number of users per weekday and weekend days, with the <br /> maximum number expected at any one event <br /> 4. Total nthmber ef 5eate capacity for the venue <br /> 5. Types of accessory uses, if any, envisioned on the site (includes <br /> any accessory structures) <br /> 6. Total number of employees, both full-time and part-time. <br /> 7 . Any and all other relevant information that will help describe the <br /> facility <br /> 8. Building elevations for all permanent structures to be used to <br /> accommodate receptions and/or events on the site <br /> b. The minimum size of the proposed site shall be based on the following <br /> eentain at least five r_en aer-es. <br /> IC-apacity Minimum Acreage Required <br /> Up to 100 guests 5 <br /> 101-200 guests 7 .5 <br /> 201-300 or more guests 10 <br /> c. A residential structure that is used for a reception facility shall not <br /> be altered in any way that changes its general residential appearance. <br /> Building height and other dimensional requirements for new construction <br /> shall be governed by the zoning district in which the property is located. <br /> New construction must meet commercial design standards. <br /> d. All structures, viewing areas, seating and parking areas shall be set <br /> back at least one two hundred (4-99 200) feet from any street or property <br /> line. <br /> a . When a site contains existing vegetation that will remain <br /> undisturbed and creates complete visual separation and serves to <br /> abate noise levels, the Board of Adjustment, as part of the <br /> Conditional Use Permit consideration process, may reduce the <br /> required setbacks of 200 feet to no less than 100 feet. <br /> i. If the applicant proposes to use this provision, following <br /> shall be provided as part of the conditional use permit <br /> application: <br /> 1. Tree survey showing existing vegetation <br /> 2. Landscape plan that provides supplemental plantings as <br /> needed to fill gaps that may exist <br /> b. When the applicant demonstrates to the Board of Adjustment that the <br /> existing vegetation meets the intent of the buffer requirement this <br /> area may be used to satisfy the buffer requirement of standard "h" <br /> of this section. <br /> e. Where waterbodies exist on or near the property, additional setbacks may <br /> be required. See Chapter 4, Waterbody Buffer Zone. <br /> f. Outdoor lights must be shielded to direct light and glare only onto the <br /> facilities' premises but may be of sufficient intensity to discourage <br />
