August 21, 2017 (Regular Meeting) Page 3248 <br /> Ordinance No. 2017-46 <br /> AN ORDINANCE AMENDING THE CABARRUS COUNTY DEVELOPMENT ORDINANCE <br /> TEXT2017-00004 <br /> BE IT ORDAINED that the Cabarrus Development Ordinance is hereby amended as <br /> follows: <br /> ADD the following definition to CHAPTER 2, RULES OF CONSTRUCTION AND DEFINITIONS <br /> Permanent Temporary Event Facility <br /> A permanent site intended to accommodate uses that are typically held outdoors <br /> and temporary in nature, such as festivals, car shows, RV shows, circuses, <br /> fairs, craft fairs, concerts, fund raising events, etc. and includes customary <br /> and incidental uses related thereto. <br /> AMEND CHAPTER 3 TEXT AND PERMITTED USE TABLE TO ADD <br /> Permanent Temporary Event Facility as a use permitted based on standards in the <br /> General Commercial zoning district <br /> ADD the following as a NEW USE to CHAPTER 7, PERMITTED BASED ON STANDARDS <br /> Permanent Temporary Event Facility <br /> 1. The site must be a minimum of 10 acres. <br /> 2. The site must be located off of, and have direct access to, a major or <br /> minor thoroughfare. <br /> 3. The site must have at least one permanent building that supports typical <br /> and customary uses accommodated on the site. Examples include enclosed <br /> event space, a catering kitchen, snack bar or pavilion. Permanent <br /> restroom facilities shall be incorporated into this building. <br /> 4 . Minimum parking requirements for ADA parking on the site shall be met <br /> and shall include walkways for patrons to access the event site. <br /> a. These parking spaces and walkways may be surfaced with asphalt, <br /> concrete, brick, pavers, crushed stone, compacted earth or an <br /> equivalent material, such as a stabilizer solution that can be <br /> mixed with crushed aggregate that is considered acceptable for <br /> pedestrian and ADA access. All surfaces should be firm and stable. <br /> b. To the greatest extent possible, the site shall comply with the <br /> Americans with Disabilities Act as it relates to outdoor developed <br /> Areas. <br /> 5. If the site will not be used on a weekly basis, the required number of <br /> parking spaces, not including the required Handicapped Parking Spaces, <br /> may be turf. Perimeter and interior parking lot landscape requirements <br /> and parking requirements as outlined in the Commercial Design Standards <br /> related to parking areas, shall not apply to turf parking areas. <br /> 6. All trash facilities, dumpsters and/or bathroom facilities shall be <br /> located at least 100 feet from any property line. This includes any <br /> additional dumpsters or temporary bathroom facilities used for events. <br /> 7. Signage shall be permitted in accordance with Chapter 11, Table 11-1, <br /> Standards for Permanent Signage in the GC district, Combined Development <br /> standards. <br /> 8. Temporary tents, stages and other temporary structures may be used on <br /> the site for events and vendors. Required permits and inspections must <br /> be secured from the Cabarrus County Fire Marshal' s office and/or <br /> Construction Standards. <br /> 9. Alcohol sales is prohibited unless otherwise permitted by state law. <br /> 10. On site emergency personnel may be required as determined by the Fire <br /> Code for Special Events. <br /> BE IT ALSO ORDAINED that the Cabarrus County Development Ordinance is hereby <br /> amended as follows: <br /> RENUMBER AND REVISE the Table of Contents and page numbers in the Cabarrus <br /> County Development Ordinance to correspond to the text changes as needed. <br /> Adopted this 15th day of May 2017 by the Cabarrus County Board of Commissioners. <br /> /s/ Stephen M.
