June 15, 2015 (Regular Meeting) Page 2436 <br />Vice Chairman Poole presented a service award in appreciation of his <br />service and dedication to the county. <br />Sergeant Nance accepted the award and expressed appreciation. <br />(D) INFORMAL COMMENTS <br />Chairman Morris opened the meeting for Informal Public Comments at 6:51 <br />p.m. He stated each speaker would be limited to three minutes. <br />Larry Marlowe, resident of 664 Odell School Road in Concord, advised of <br />new development and expressed concerns regarding the capacity of the new <br />Odell 3 -5 Elementary School. <br />With there being no one else to address the Board, Chairman Morris <br />closed that portion of the meeting. <br />(E) OLD BUSINESS <br />(E -1) County Manager - Proposed Exchange of Property on Rankin Road <br />Jonathan Marshall, Deputy County Manager, advised the proposed exchange <br />of property on Rankin Road is back before the Board due to a requirement to <br />approve an advertisement for the property exchange. He requested approval of <br />the resolution and stated a public hearing is not required. <br />UPON MOTION of Commissioner Honeycutt, seconded by Commissioner Shue <br />and unanimously carried, the Board adopted the resolution authorizing the <br />exchange of property of equal value and authorized the County Manager and <br />County Attorney to complete the transaction. <br />Resolution No. 2015 -13 <br />Resolution Authorizing Exchange of Property <br />Rankin Road Property <br />WHEREAS, Cabarrus County is the owner of a parcel of land located at <br />the end of Rankin Road that is part of the larger parcel on which Lake Howell <br />is located (the "Property "); and <br />WHEREAS, N.C. General Statute 160A -271 permits the County to exchange <br />real property by private negotiation for full and fair consideration; and <br />WHEREAS, the County has negotiated terms of an exchange for a parcel <br />located off Rankin Road that is part of Parcel Identification Number 4692 -24- <br />0783 and is of similar size and tax value; and <br />WHEREAS, the owner of that property Robert Fishel has agreed, at his <br />expense, to have a survey completed of the County property to be exchanged so <br />that the County may ensure it is of fair and equal value for the Fishel land <br />included in the exchange; <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT; <br />1. The County Commissioners authorize the exchange of the property <br />described above through the procedures outlined in North Carolina <br />General Statute 160A -271. <br />2. The County Clerk shall cause a notice of the proposed exchange to be <br />published. The notice shall describe the property and the proposed <br />exchange. <br />3. The terms of exchange are that <br />a. The County Manager and County Attorney must complete the final <br />terms and conditions for the property exchange. <br />b. The exchange documentation must include any restrictions <br />requested by the Board of Commissioners in consultation with the <br />Water & Sewer Authority Board. <br />Adopted this 15th day of June, 2015. <br />/s/ Stephen M.
