Morris, Chairman <br />Cabarrus County Board of Commissioners <br />(D) INFORMAL COMMENTS <br />Chairman Morris opened the meeting for Informal Public Comments at 6:51 <br />p.m. He stated each speaker would be limited to three minutes. <br />With there being no one to address the Board, Chairman Morris closed <br />that portion of the meeting. <br />(E) OLD BUSINESS <br />None. <br />(F) CONSENT <br />(F -1) County Manager - ABC Permits on Property Leased from the County <br />The County leases property to some outside agencies and is considering <br />other leases. Requests have been made, potentially with more requests in the <br />future, for leaseholders to be permitted to serve alcohol as a part of their <br />business practice or for events. The Board has not established a policy on <br />how to address these requests. The ABC permits and all requirements of those <br />permits would be the responsibility of the leaseholders. <br />The discussion at the September meeting provided staff direction on how <br />to handle these issues in the future. A policy based on those discussions is <br />attached. <br />UPON MOTION of Commissioner Honeycutt, seconded by Commissioner Mynatt <br />and unanimously carried, the Board adopted the Policy on Sale and Use of <br />Alcohol on County Property. <br />CABARRUS COUNTY BOARD OF COMMISSIONERS <br />POLICY ON SALE AND USE OF ALCOHOL ON COUNTY PROPERTY <br />INTRODUCTION. <br />Cabarrus County does not have a comprehensive policy on the sale and <br />use of alcohol on County -owned or County -- leased property. At its September <br />8, 2015 work session, the Board of Commissioners discussed this issue and by <br />consensus determined that enactment of a policy on sale and use of alcohol on <br />County property would be beneficial. <br />There are two areas in which previously enacted laws govern sale and <br />use of alcohol on County property. Section 50 -4 of the Cabarrus County Code <br />of Ordinances prohibits the possession of alcoholic beverages in any of the <br />County`s parks. N.C. Gen. Stat. §18B- 301(f) (7) prohibits the possession or <br />use of alcohol on school property used for school purposes. <br />Thus, the remaining issue of alcohol sale and use on other County <br />properties is subject to Board action, either in individual circumstances <br />previously determined or future regulation. <br />POLICY <br />It is the policy of this Board and subsequent boards of commissioners, <br />unless changed by such board, that alcoholic beverages shall not be <br />possessed, used, or consumed on County -owned or County - leased property, <br />unless allowed at the discretion of the Board or under one of the following <br />exceptions or situations: <br />1. By specific contract or lease agreement with a tenant. For example, <br />the County has a contract with SMG for management of the Cabarrus <br />Arena and Events Center that allows for alcohol sale and use under <br />certain conditions, and the County has a lease with the Arts Council <br />and Historic Cabarrus Association for the Historic Cabarrus <br />Courthouse that allows for alcohol sale and use under certain <br />conditions. <br />2. In future contracts and lease agreements, the County will require <br />the following provisions be a part of any such document: <br />
