February 17, 2014 (Regular Meeting) Page 1923 <br />requires Board review. Staff has requested additional information to ensure <br />that local regulations, liability coverage, property maintenance and exact <br />property use are addressed in the lease. The dealership has offered to pay <br />$1500.00 per month, with a lump sum advance payment of $15,000.00, equivalent <br />to 10 months. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner <br />Oesterreich and unanimously carried, the Board adopted the resolution <br />approving the one -year lease and authorized the County Manager to negotiate <br />and execute the agreement on behalf of the County, subject to review and /or <br />revision by the County Attorney. <br />Resolution No. 2014 -02 <br />RESOLUTION APPROVING LEASING PROPERTY <br />WHEREAS, Cabarrus County owns property at the corner of Cabarrus Avenue <br />and Union Cemetery Road in Concord, N.C. identified by County Parcel <br />Identification Numbers 5620022757, 5620024830, 5620024526 and 5620025371; and <br />WHEREAS, Cabarrus County does not have any planned use for this <br />property at this time: and <br />WHEREAS, Ben Mynatt Chevrolet - Cadillac has requested up to a one year <br />lease for a portion of this property; and <br />WHEREAS, the County and Ben Mynatt Chevrolet - Cadillac are negotiating <br />terms for said lease for this property with final terms to be determined by <br />the County Manager and County Attorney; and <br />WHEREAS, in consideration of leasing such space, Ben Mynatt Chevrolet - <br />Cadillac has agreed to pay $1500 per month; and <br />WHEREAS, North Carolina General Statutes $ 16OA -272 (b) authorizes the <br />County to enter into a lease for up to one year upon resolution of the Board <br />of Commissioners adopted at a regular meeting without public notice required; <br />THEREFORE, THE CABARRUUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br />The Board of Commissioners hereby approves a lease of the County <br />property described above to Ben Mynatt Chevrolet- Cadillac with final terms to <br />be determined by the County Manager and County Attorney for one year or less <br />and directs the County Manager to execute any instruments necessary to <br />effectuate the lease. <br />Adopted this the 17 day of February, 2014. <br />/s/ Elizabeth F. Smit <br />Clerk to the Board <br />(F -3) EMS - Approval of EMS Co- location with Harrisburg Fire Station 3 <br />It is proposed that EMS #10 move to a permanent home in the new <br />Harrisburg Fire Station #3 that will be constructed on Rocky River Road in <br />Harrisburg. EMS 410 was operating out of a job trailer and then a small area <br />at Harrisburg Station #2 for several years in anticipation of this permanent <br />move. <br />Construction is planned to be completed in December 2014. EMS will <br />occupy approximately 20 percent of the new structure. The total amount is <br />proposed to be paid in a lump sum of $375,000.00, in return for a 50 -year <br />lease. The use of one -time funds (fund balance) was discussed for this <br />proposal, although this can be included in the FY 2014/15 budget, since funds <br />will be expended in FY 15. A formal contract will be developed between <br />Cabarrus County and the City of Harrisburg at a later point and presented to <br />the Board for approval. This action does not require any personnel <br />additions. <br />A similar arrangement has already been approved for a joint station <br />with Kannapolis on Barr Road, and the current budget includes funds for a <br />joint station on Weddington Road that is being constructed by Concord. <br />
