December 15, 2034 (Regular Meeting) Page 2230 <br />The plan of refinancing for the one or more prior installment financing <br />contracts and the Projects involves the entry by the County into the <br />Contracts with one or more third parties who will provide the County with up <br />to $211, 615, 000 pursuant to the terms of the Contracts, which amount will be <br />applied to provide refinancing of the one or more prior installment financing <br />contracts and the Projects. The County's obligations to such one or more <br />third parties supplying financing are authorized by North Carolina General <br />Statutes Section 160A -20 and will be secured by a lien upon or security <br />interest in all or some portion of the Projects and /or in all or some portion <br />of the real property on which the Projects are located. <br />The obligations of the County under the Contracts will not be deemed to <br />be a pledge of the faith and credit of the County within the meaning of any <br />constitutional debt limitation and the Contracts will not directly or <br />indirectly or contingently obligate the County to make any payments beyond <br />those appropriated in the sole discretion of the County for any fiscal year <br />in which the Contracts are in effect. ANY PERSON <br />WISHING TO COMMENT IN WRITING ON THE PLAN OF REFINANCING MAY DO SO BY <br />DELIVERING SUCH COMMENTS TO THE UNDERSIGNED AT 65 CHURCH STREET SE, CONCORD, <br />NORTH CAROLINA, 28026, WITHIN 5 DAYS FROM THE DATE OF PUBLICATION OF THIS <br />NOTICE. <br />(F -lx) Infrastructure and Asset Management - Request to Close a Portion of <br />M--+-', n.-; ,tee <br />Cabarrus County Schools has requested the Board of Commissioners and <br />the Mount Pleasant Board of Commissioners communicate an intent to the N.C. <br />Department of Transportation (NCDOT) to permanently close a portion of the <br />public right -of -way for North Drive in Mt. Pleasant. <br />The indication of intent is the first step in acting to close the <br />right -ef -way. NCDOT will then consider the matter at one of their board <br />meetings. If they recommend closure, the action will come back before both <br />Boards of Commissioners for an official public hearing and resolution to act <br />on the closure. <br />A public meeting was held at the Cabarrus County Schools' offices on <br />Tuesday, November 18, 2014 and all property owners who use North Drive for <br />access were notified. That meeting was an opportunity for them to look at <br />the plans for the construction of Mount Pleasant Middle School and to view <br />the proposal for closing part of North Drive. <br />UPON MOTION of Commissioner Shue, seconded by Commissioner Honeycutt <br />and unanimously carried, the Board approved the resolution requesting <br />consideration of the closure of a public road. <br />Resolution No. 2014 -28 <br />RESOLUTION REQUESTING CONSIDERATION FOR THE CLOSURE <br />OF STATE ROAD 2481 (NORTH DRIVE), RUNNING <br />THROUGH THE MT. PLEASANT MIDDLE SCHOOL CAMPUS <br />WHEREAS, a portion of North Carolina State Road 2481 (North Drive) in <br />Cabarrus County dissects the Mt. Pleasant Middle School property, being a <br />paved road within the school property boundaries; and <br />WHEREAS, General Statute 153A -241 requires that the Board of Commissioners <br />adopt a resolution declaring its intent to close the public road or easement <br />to start the process to consider that closure; and <br />WHEREAS, the Cabarrus County Board of Commissioners is considering the <br />request for closure and abandonment of State maintenance for this area at the <br />request Cabarrus County Schools, as described on the attached Exhibit, but <br />
