February 4, 2013 (Work Session) <br />Active Living and Parks Department - FCCA /Park Ordinance <br />Page 1409 <br />Londa Strong, Active Living and Parks Director, advised the F.C. <br />Carolina Alliance (FCCA) Soccer Group (part of the agreement for use of the <br />Frank Liske Park Soccer Complex) held a tournament the weekend of November 9- <br />11, 2012. She stated the park ranger on duty discovered some opened and <br />unopened alcohol containers. The ranger also reported there was an adult game <br />after the tournament games; however the complex is currently for "youth only" <br />to protect and to aid in the establishment of the turf. Strong advised the <br />Park Ordinance allows for the implementation of up to a 30 day suspension for <br />one violation. The penalty for a second violation is left to the decision of <br />the Board of Commissioners. She stated county management, the county <br />attorney and Active Living and Parks staff met with FCCA to discuss the <br />violations. Richard Koch, County Attorney, worked with the department in <br />crafting a letter to the FCCA President advising of the 30 day suspension and <br />procedures for the second violation. In regards to the first violation, the <br />30 day suspension was reduced to a two week suspension. The penalty for the <br />second violation is to be determined by the Board of Commissioners. <br />Paul Haddad, FCCA President, stated there had been some changes in <br />their organization since the violation; they have worked to improve <br />communication. He urged the Board to consider a monetary penalty or community <br />service in lieu of a suspension. Haddad advised the FCCA will strive to obey <br />the Park Ordinance and any future infractions will be dealt with <br />appropriately. Shane Carew, FCCA Executive Director; and Michael Applegate, <br />Cabarrus CVB and FCCA Board Member, were also in attendance. <br />Mike Downs, County Manager, clarified the first offense was the on -site <br />alcoholic beverages and has been dealt with by management. He advised the <br />second offense was the adult soccer game played on the "youth only" fields at <br />the complex. He reviewed options for the board. He also stated discussions <br />are ongoing regarding revisions to the agreement between Cabarrus County and <br />FCCA that would enable other organizations use of the complex. He responded <br />to questions from the Board. <br />Commissioner Burrage expressed support for waiving any penalties. <br />Discussion followed. <br />Vice Chairman White questioned what measures the FCCA will implement to <br />ensure the violations do not happen in the future. He also expressed support <br />for waiving a penalty for the second violation but not the first violation <br />concerning alcohol at the Park. <br />
