The proposed language codifies when existing 45' right -of -ways may be used for access and clarifies that private roads must be built to the public standard. The proposed language adds an optional certificate that may be used for exemption plats and corrects typos in other certificates. Chairman Poole opened the public hearing at 6:57 p.m. The Public Hearing Notice was published on May 15, 2013 in The Independent Tribune. The Public Hearing Notice was also posted on the County's website ( www.cabarrus county. us ) on May 8 and 15, 2013 in accordance with Article 2, Administration, Section 2.1 (Use of Electronic Means to Provide Public Notices) of the Cabarrus County Code of Ordinances. There was no one present to address the Board; therefore, Chairman Poole closed the public hearing. UPON MOTION of Vice Chairman White, seconded by Commissioner Burrage and unanimously carried, the Board adopted the following ordinance: Ordinance No. 2013 -10 AN ORDINANCE AMENDING THE CABARRUS COUNTY SUBDIVISION ORDINANCE TEXT2013 -00002 BE IT ORDAINED that the Cabarrus County Subdivision Ordinance is hereby amended as follows: AMEND Section 5, Final Plat Requirements, C- Certifications Certifications - the following certificates shall be shown on the Final Plat as applicable: 1. CERTIFICATE OF OWNERSHIP AND DEDICATION I (We) hereby certify that I am (we are) the owner(s) of the property shown and described hereon and that I (We) hereby adopt this plan of subdivision with my (our) free consent, established minimum building lines, and dedicate all roads, alleys, walks, parks, and other sites to the public use except as noted. Further, I (We) certify the land as shown hereon is within the platting jurisdiction of Cabarrus County. Date Property Owner 2.
