Road maintenance shall hereby be the responsibility of the <br />Homeowners Association and roads shall be maintained to the <br />minimum standards of the North Carolina Department of <br />Transportation until the respective governmental agency takes <br />over this responsibility. The road maintenance agreement is <br />recorded in Deed Book Page of the Cabarrus County <br />Register of Deeds. <br />Date Property Owner and Developer <br />6. CERTIFICATE OF WATER AND SEWER CONNECTION FEE PAYMENT <br />(only if Concord public utility extensions are required). <br />a. I hereby certify that all water and sewer connection fees for the <br />Subdivision have been paid, or that the fees are <br />not applicable since preliminary plat approval occurred prior to <br />June 28, 1996. <br />Date <br />Finance Director <br />b. Approval by the Subdivision Administrator is conditioned upon the <br />plat being registered in the Office of the Register of Deeds within <br />thirty (30) days of such approval and receipt of record presented <br />to the Planning Department. <br />7. Existing 45 Foot Right -Of- Way <br />Where a 45 foot right -of -way exists and lot access cannot be gained from a <br />state maintained right -of --way, up to 20 lots may use the existing right -of- <br />way to access a public street. Increasing the length of the existing right - <br />of -way to accommodate new lots is not permitted. <br />For additional lots to access the existing 45 foot private right -of -way, the <br />following shall apply: <br />a. The travel way must be at least 12 feet wide with gravel four <br />inches deep. In addition, the first 25 feet of the road must <br />be 18 feet wide and paved when the private road adjoins a <br />paved road. <br />b. Vehicle turnarounds must be provided at the end of all dead <br />end roads. <br />c. The subdivider is responsible for obtaining a permit for <br />access to a state maintained road. <br />d. A right -of -way maintenance agreement that includes all <br />parties that use the right -of -way must be recorded in the <br />office of the Register of Deeds to ensure proper maintenance. <br />In the event a right -of -way maintenance agreement is already <br />recorded, said document shall be amended to include new lots <br />and property owners to the Agreement.
