August 19, 2013 (Regular Meeting) <br />Page 1683 <br />date, a notice will be sent and a penalty will be applied to the unpaid <br />balance in accordance with the terms and conditions governing payments set by <br />the Board of Directors. <br />3.8 Termination of Services <br />(a) If any charges remain, after the final due date set by the Executive <br />Director in accordance with Board of Directors policy and procedures, <br />water and sewer services may be terminated. Before services can be <br />reinstated, the balance must be paid in full. <br />(b) In addition, failure to pay in a timely manner may cause WSACC to <br />initiate action to revoke a user's wastewater discharge permit. <br />(c) Any discharge by the user after revocation of the wastewater discharge <br />permit will be subject to a fine of twenty -five thousand dollars <br />($25,000.00) per day for as long as the discharge continues without a <br />valid permit. <br />SECTION 4 - WASTEWATER DISCHARGE PERMIT APPLICATION AND ISSUANCE <br />4.1 Wastewater Dischargers <br />(a) It shall be unlawful for any person to connect or discharge to the POTW <br />without first obtaining the permission of WSACC. Any user proposing to <br />discharge any industrial waste to the POTW or who is now doing so must <br />make application to WSACC for a wastewater discharge permit. <br />(b) Any industrial user proposing to change the volume or characteristics of <br />an existing discharge shall request from WSACC a determination as to <br />whether or not a new application should be filed and shall provide <br />sufficient information on the proposed change to enable WSACC to <br />determine the need for a new application. If the proposed change requires <br />a revision in a current SIU or local permit or requires a different type <br />of permit be issued, the user shall apply to WSACC for an appropriate <br />wastewater discharge permit within 45 days of the notification. <br />(c) When requested by the Executive Director, a user must submit information <br />on the nature and characteristics of its wastewater within thirty (30) <br />days of the request. The Executive Director is authorized to prepare a <br />form for this purpose and may periodically require users to update this <br />information. <br />(d) Any person discharging or proposing to discharge wastewater into the POTW <br />shall be responsible at all times for determining the volume and <br />characteristics of its existing or proposed discharge. <br />4.2 Wastewater Discharge Permit Requirements <br />(a) (1)All persons meeting one or more of the requirements of an SIU of this <br />ordinance shall obtain an industrial user pretreatment permit prior to <br />the commencement of construction or operations which will result in a <br />discharge to the POTW. Existing industrial users who are determined by <br />the Executive Director to be SIUs shall obtain an industrial user <br />pretreatment permit within 180 days of receiving notification of the <br />Executive Director's determination. <br />For purposes of this definition, construction or operation has commenced <br />if the owner or operator has: <br />(i) Begun, or caused to begin as part of a continuous on -site <br />construction program: <br />(A) Any placement, assembly, or installation of facilities or <br />equipment; or <br />
