August 19, 2013 (Regular Meeting) Page 1715 <br />WSACC, is required at the owner's expense to install suitable toilet facilities <br />therein and to connect such facilities directly to the proper sewer in <br />accordance with the provisions of this ordinance, within ninety (90) days after <br />date of official notice to do so provided the proper wastewater sewer is within <br />three hundred (300) feet of the property line. This section shall not apply to <br />any person served by a privately constructed, owned, operated, or maintained <br />wastewater sewer and wastewater treatment facility that discharges directly to <br />a natural outlet in accordance with the provisions of this ordinance and <br />applicable state and federal laws. <br />SECTION 17- PRIVATE SEWAGE DISPOSAL <br />Regulations concerning private sewage disposal will be enforced by the Cabarrus <br />Health Alliance in accordance to 10 NCAC 10A.1900. <br />SECTION 18 - OUTSIDE CONNECTIONS <br />Any person owning or controlling premises located beyond the corporate limits <br />or boundaries of WSACC and desiring to install a plumbing system for the <br />purpose of discharging domestic sewage and /or industrial waste into the POTW <br />may do so by complying with the requirements of this ordinance and of the <br />public utility having jurisdiction over the sanitary sewer to which the <br />connection is proposed to be made. <br />SECTION 19 - SPECIAL AGREEMENTS <br />Nothing in this ordinance shall be construed as preventing any special <br />agreement or arrangement between the Board of Directors and any user of the <br />wastewater treatment system whereby wastewater of unusual strength, character <br />or quantity is accepted into the system and specially treated subject to any <br />payments or user charges as may be applicable, provided such wastewater will <br />not interfere with the treatment process, sludge disposal options, NPDES <br />permit compliance or cause a violation of water quality standards. <br />SECTION 20 - SEVERABILITY <br />If any provision, paragraph, word, section or article of this ordinance is <br />invalidated by any court of competent jurisdiction, the remaining provisions, <br />paragraphs, words, sections, and chapters shall not be affected and shall <br />continue in full force and effect. <br />SECTION 21 - CONFLICT <br />All other ordinances and parts of other ordinances inconsistent or <br />conflicting with any part of this ordinance are hereby repealed to the extent <br />of such inconsistency or conflict. <br />SECTION 22 - PUBLIC NOTIFICATION OF UNTREATED WASTE AND <br />WASTEWATER DISCHARGES <br />(a) All wastewater spills that reach the surface waters (regardless of <br />volume) and all spills to the ground surface exceeding 1,000 gallons <br />(regardless of whether they are contained or reach surface waters) should <br />be reported by the discharger to the State's Department of Environment <br />and Natural Resources regional office. <br />(b) Whenever a discharge of untreated wastewater of 1,000 gallons or more <br />reaches surface waters, a press release must be sent by the discharger to <br />all print and electronic news media providing general coverage in the <br />county where the discharge occurred. The press release is to be issued <br />within 48 hours of the determination that the wastewater has reached <br />surface waters. A copy of the press release and a list of the media to <br />which it was distributed must be kept on file by the user for at least <br />one year and copies made available upon request. <br />(c) If the untreated discharge to the surface waters is 15,000 gallons or <br />more, the discharger must issue a press release and a notice of the <br />discharge must be published in a newspaper with general circulation in <br />the county where the discharge occurred and in each county downstream <br />that is significantly affected. The Secretary of the Department of <br />Environment and Natural Resources determines which counties are <br />significantly affected, and publication must occur within 10 days of this <br />
