January 17, 2012 (Regular Meeting) Page 941 Randy Bass, Transportation Director, advised that the Department will apply for grant funding totaling $729,699.00 from the North Carolina Department of Transportation - Public Transportation Division (NCDOT -PTD) via the Federal Transportation Administration (FTA) Section 5311 Grant for Fiscal Year 2013. The grant funds totaling $729,699.00 must be designated for the administrative and capital costs associated with Cabarrus County Transportation Services (CCTS). A public hearing on the grant application is required in addition to a 15 (fifteen) percent match for the administrative grant award, a 10 (ten) percent match for the capital grant award and adoption of the Community Transportation Program and Human Services Agency Transportation resolutions. The required local match will be included in the Departments FY 12 -13 budgetary request. Chairman Poole opened the public hearing at 7:09 p.m. The Public Hearing Notice was published on January 4, 2012 in English and Spanish in THE INDEPENDENT TRIBUNE. The Public Hearing Notice was also posted on the County's website ( www.cabarruscounty.us ) in English and Spanish on January 4, 2012 in accordance with Article 2, Administration, Section 2.1 (Use of Electronic Means to Provide Public Notices) of the Cabarrus County Code of Ordinances. There was no one present to address the Board; therefore, Chairman Poole closed the public hearing. UPON MOTION of Commissioner Carruth, seconded by Commissioner White and carried, with Chairman Poole, Vice Chairman Burrage and Commissioners Carruth and White voting for and Commissioner Measmer voting against, the Board adopted the following resolutions: Resolution No. 2012 -03 HUMAN SERVICE AGENCY TRANSPORTATION RESOLUTION State Funds FY 2013 RESOLUTION Applicant seeking permission to apply for Human Service Transportation funding, enter into agreement with the North Carolina Department of Transportation, provide the necessary assurances, and the required local match. A motion was made by Commissioner Robert W. Carruth and seconded by (Commissioner H. Jay White, Sr. for the adoption of the following resolution, and upon being put to a vote was duly adopted. WHEREAS, Article 2B of Chapter 136 of the North Carolina General Statutes and the Governor of North Carolina have designated the North Carolina Department of Transportation ( NCDOT) as the agency responsible for administering federal and state public transportation funds; and WHEREAS, the North Carolina Department of Transportation receives funds from the North Carolina General Assembly to provide assistance for rural public transportation projects; and WHEREAS, the purpose of these transportation funds is to provide grant monies to local agencies for the provision of rural public transportation services; and WHEREAS, Cabarrus County hereby assures and certifies that it will provide the required local matching funds; that its staff has the technical capacity to implement and manage the project, prepare required reports, obtain required training, attend meetings and conferences; and agrees to comply with the federal and state statutes, regulations, executive orders, and all administrative requirements related to the applications made to and grants received from the North Carolina Department of Transportation; NOW, THEREFORE, be it resolved that the (Authorized Official's Title)* County Manager of (Name of Applicant's Governing Body) Cabarrus County Board of Commissioners is hereby authorized to submit a grant application for state funding, make the necessary assurances and certifications and be empowered to enter into an agreement with the NCDOT to provide rural public transportation services.
