May 7, 2012 (Work Session) Page 1043 <br />In response to questions from the Board, Mr. Testerman explained the <br />existing stormwater infrastructure at Cox Mill Elementary School will be <br />replaced or retrofitted with "best management practices" to keep and treat <br />runoff on site and to improve water quality in the Clarke Creek and Rocky <br />River. Both water bodies, he said, are designated as "impaired" by state and <br />federal water quality officials. The school site is also part of the state - <br />designated, regionally- important Clarke Creek Heron Rookery Significant <br />Natural Heritage Area. Mr. Testerman and Mike Downs, County Manager, <br />responded to questions from the Board. Commissioner Carruth addressed the <br />need to have conservation efforts included in future school site design <br />processes. Richard Koch, County Attorney, advised there were difficulties <br />with the original contractor who installed the School Park improvements and <br />that he was back - charged in a substantial amount for problems with his work <br />on the project and for failure to meet construction deadlines. <br />County Manager - Sale of Foreclosed Property <br />Jonathan Marshall, Deputy County Manager, presented the following <br />information: <br />The County owns a number of smaller parcels that were obtained <br />through foreclosure for taxes due. Those properties may be sold <br />based on the methods and rules described in G.S. 105 -376 and G.S. <br />160A -266. General Services has been providing basic maintenance <br />of those properties, but it would be more cost effective to sell <br />or transfer them. Staff suggests the use of sealed bids with a <br />minimum price of total taxes owed be used for these sales. <br />Mike Downs, County Manager, advised other measures to dispose of the <br />properties were unsuccessful. <br />County staff responded to questions from the Board. Chairman Poole <br />requested a list of the properties. It was noted the list will be included <br />in the agenda packet. <br />County Manager - Discuss Options for the Old Bethel School Property <br />Mike Downs, County Manager, advised Woodson University withdrew its <br />offer to purchase the property some time ago and demolishing the buildings <br />would be the next option. County staff approached the Town of Midland with <br />an offer to donate the property to the Town for public use. Midland is close <br />to making a decision and finding an end user. <br />Vice Chairman Burrage advised there is a group interested in acquiring <br />the property for preservation as long as there are no restrictions attached <br />to it. Commissioner White expressed his preference for demolishing the <br />property and selling for a profit. Chairman Poole asked Vice Chairman <br />Burrage to contact Mayor Kitts. Commissioner Carruth suggested the property <br />be certified for economic development purposes if the buildings are <br />demolished. <br />Finance - Mt. Pleasant High School Communications Tower Lease - Resolution <br />Approving Lease of Communication Tower Co- Location Space <br />Richard Koch, County Attorney, presented the following information: <br />The County owns a communication tower adjacent to Mt. Pleasant <br />High School with co- location space surplus to the County's needs. <br />USA Mobility will lease space on the tower for a term of five (5) <br />years, beginning May 2012 at a monthly rental rate of $585.00 <br />with a three (3) percent annual rent increase on each anniversary <br />date. N.C. General Statutes §160A -272 authorizes the County to <br />enter into leases of up to 10 years upon resolution of the Board <br />of Commissioners adopted at a regular meeting after 10 days <br />public notice. <br />Mr. Koch and Jonathan Marshall, Deputy County Manager, responded to <br />questions from the Board related to notice requirements and the tower's <br />inability to accept additional tenants according to the structural analysis. <br />BOC - Animal Shelter Future Operations and Relationship with Humane Society <br />Commissioner Carruth presented the following information: <br />
