May 21, 2012 (Regular Meeting) Page 1067 <br />March 31, 2012. The application was approved by the Kannapolis City School <br />Board on April 16, 2012. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board approved the Kannapolis City Schools ADM <br />application and authorized the Cabarrus County Board of Commissioners' Chair <br />to execute the application. <br />(F -9) Finance - Mt. Pleasant High School Communications Tower Lease - <br />Resolution Approving Lease o - L Communication Tower Co- Location Space <br />The County owns a communication tower adjacent to Mt. Pleasant High <br />School with co- location space surplus to the County's needs. USA Mobility <br />will lease space on the tower for a term of five years, beginning May 2012 at <br />a monthly rental rate of $585.00 with a 3 percent annual rent increase on <br />each anniversary date. <br />The Public Notice was posted on the County's website <br />( www.cabarruscounty.us ) on May 8, 2012 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public <br />Notices) of the Cabarrus County Code of Ordinances. <br />UPON MOTION of Vice Chairman Burrage, seconded by Commissioner Measmer <br />and unanimously carried, the Board adopted the resolution enabling Cabarrus <br />County to lease co- location space on the communications tower to USA <br />Mobility; and, authorized the County Manager to execute the contract <br />documents subject to review and approval by the County Attorney. <br />Resolution No. 2012 -07 <br />RESOLUTION APPROVING LEASING PROPERTY <br />WHEREAS, Cabarrus County owns a communication tower adjacent to Mt. <br />Pleasant High School in Mt. Pleasant, North Carolina with co- location space <br />available for wireless communications providers; <br />WHEREAS, the Board of Commissioners finds that such cc- location space <br />is surplus to the County's needs; and <br />WHEREAS, the County and USA Mobility Wireless, Inc. have agreed upon a <br />lease under which USA Mobility Wireless, Inc. will lease space on the County <br />communications tower for a term of five years, beginning May, 2012; and <br />WHEREAS, in consideration of leasing such space, USA Mobility Wireless, <br />Inc. has agreed to pay monthly rent of $585.00 with a 3% annual rent <br />increase; and <br />WHEREAS, North Carolina General Statutes § 160A -272 authorizes the <br />County to enter into leases of up to 10 years upon resolution of the Board of <br />Commissioners adopted at a regular meeting after 10 days public notice; <br />WHEREAS, the required notice has been published and the Board of <br />Commissioners is convened in a regular meeting. <br />THEREFORE, THE CABARRUS COUNTY BOARD OF COMMISSIONERS RESOLVES THAT: <br />The Board of Commissioners hereby approves a nonexclusive lease of the <br />County property described above to USA Mobility Wireless, Inc. for five years <br />and directs the County Manager to execute any instruments necessary to <br />effectuate the lease. <br />Adopted this the 21 day of May, 2012. <br />/s/ Elizabeth F.
