July 16, 2012 (Regular Meeting) <br />Page 1171 <br />Ordinance No. 2012 -11 <br />AN ORDINANCE AMENDING THE CABARRUS COUNTY ZONING ORDINANCE <br />TEXT2012 -00001 <br />BE IT ORDAINED that the Cabarrus County Zoning Ordinance is hereby amended as <br />follows: <br />The following Chapters shall be DELETED entirely: Chapter 2- Definitions, <br />Chapter 3- Establishment of Zoning Districts, Chapter 7- Performance Based <br />Standards and Chapter 8- Conditional Uses. <br />Deleted Chapters shall be REPLACED with revised Chapters: Chapter 2- <br />Definitions, Chapter 3- Establishment of Zoning Districts, Chapter 7- <br />Performance Based Standards and Chapter 8- Conditional Uses. <br />Appendix C, Trail and Trail Head Design shall be ADDED to the Zoning <br />Ordinance. <br />REVISE the Table of Contents to correspond to text changes. <br />Adopted this 16 day of July, 2012 by the Cabarrus County Board of <br />Commissioners. <br />/s/ Elizabeth F. Kay Honeycutt, Clerk to the Board <br />(G -2) Centralina COG - Presentation of "CONNECT Our Future Vibrant <br />Communities in a Robust Region" <br />Mt. Pleasant Commissioner Rick Burleyson addressed questions and <br />concerns raised at the July 2, 2012 work session about Cabarrus County's <br />participation in the "CONNECT Our Future Vibrant Communities in a Robust <br />Region" initiative. He advised participation will require the Board to <br />designate representatives, at the elected and staff level, to serve on the <br />Council and to approve the Memorandum of Understanding (MOU) between Cabarrus <br />County and the Centralina Council of Governments. <br />After a lengthy discussion and responses from County staff to questions <br />raised by the Board, Commissioner Carruth MOVED to designate Chairman Poole <br />as the delegate for the Centralina Council of Governments (CCOG) CONNECT <br />Consortium and approve the MOU. Chairman Poole seconded the motion. The <br />alternate position was left open for a volunteer. Discussion continued. <br />Vice Chairman Burrage expressed opposition to participating in the <br />initiative. Commissioner White was asked to serve as the elected <br />representative, in light of his prior experience with the COG. He agreed to <br />serve. <br />Commissioner Carruth amended his MOTION to designate Commissioner White <br />as the elected delegate with Chairman Poole as the alternate and to designate <br />Susie Morris as the staff delegate with Kelly Sifford as staff alternate and <br />to approve the Memorandum of Agreement between Cabarrus County and the <br />Centralina Council of Governments as it relates to the "CONNECT Our Future <br />Vibrant Communities in a Robust Region" initiative. Chairman Poole seconded <br />the amended motion. The MOTION carried with Chairman Poole and Commissioners <br />Carruth, Measmer and White voting for and Vice Chairman Burrage voting <br />against. <br />(G -3) Solid Waste - Ordinance Acknowledging New Conditions of Existing Solid <br />Waste Collection and Disposal Franchise Agreement with Republic Services, <br />Inc. and Renewing the Franchise Agreement Through December 31, 2017 - First <br />Reading <br />Kevin Grant, Sustainability Manager, presented the following <br />information related to a request to renew the Franchise Agreement with <br />Republic Services, Inc.: the current Agreement expires on December 31, 2012 <br />and provides Republic Services, Inc. exclusive rights and franchise to <br />collect and dispose of all the solid waste from all residential units in the <br />unincorporated sections of Cabarrus County and for the disposal of all solid <br />waste generated from the City of Kannapolis and towns of Mt. Pleasant and <br />Harrisburg; the Agreement may be renewed for one successive period of five <br />
