October 15, 2012 (Regular Meeting) Page 1272 <br />Mrs. Cook that the deputies were attempting to serve when Mr. Cook climbed <br />into his tree stand and refused to come down. <br />On these claims, the County is self - insured for the first $350,000.00 <br />of any liability loss and any amount above $2.5 million. The County's excess <br />insurer insures claims between those two limits. The excess insurance <br />carrier was willing to contribute toward these claims because of the <br />potential exposure. In view of the excess carrier's position, the County <br />believed that it should contribute its retention of $350,000.00 to a <br />settlement in order to limit its exposure. <br />This case was settled for $1 million, of which the County paid <br />$350,000.00. (The County's contribution was inclusive of the legal cost to <br />defend the lawsuit.) <br />Approval of the terms of the settlement was made by the Commissioners <br />in closed session as permitted by the Open Meetings Law. The settlement has <br />been paid to the plaintiffs' counsel and the case has been dismissed. <br />Announcement of this settlement is made pursuant to the Open Meetings <br />Law (NCGS §143- 318.11) <br />General Comments <br />The Board plans to review the Cabarrus County Schools list of requests <br />from the one time unassigned fund balance at the November work session. <br />The Board briefly discussed the Council for a Sustainable Local <br />Economy. <br />(M) ADJOURN <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Burrage, <br />and unanimously carried, the meeting adjourned at 8:05 p.m. <br />G ( v - <br />Megan mit, Clerk to the Board <br />
