He <br />urged everyone to vote. <br />Chairman Poole announced early voting begins on October 18 at the <br />Board of Election's office and on October 29 at the Kannapolis Train Depot, <br />Harrisburg Library and Concord Fire Station No. 7. <br />(K) WATER AND SEWER DISTRICT OF CABARRUS COUNTY <br />None. <br />(L) CLOSED SESSION <br />(L -1) Closed Session - To Preserve the Attorney - Client Privilege as <br />Authorized by NCGS 143- 318.11(a)(3) <br />UPON MOTION of Commissioner White, seconded by Vice Chairman Burrage <br />and unanimously carried, the Board moved to go into closed session to <br />preserve the attorney- client privilege as authorized by NCGS 143 - <br />318.11(a)(3). <br />UPON MOTION of Commissioner Measmer, seconded by Commissioner White and <br />unanimously carried, the Board moved to come out of closed session. <br />Return to Open Session <br />Announcement of Settlement of Litigation <br />Chairman Poole read the following statement of Settlement of <br />Litigation: <br />Cabarrus County has settled the case Dale F. Cook and Tammy Lynn Cook v <br />Brad Riley, Jason Thomas, Robert Wensil and Pennsylvania National Mutual <br />Casualty Insurance Company Case No. 1:11- CV -24, United States District Court <br />for the Middle District of North Carolina. <br />This was a lawsuit involving various claims against the Cabarrus County <br />Sheriff's Department by Mr. and Mrs. Cook for injuries sustained by Mr. Cook <br />when he fell or jumped from his tree stand after being tasered by sheriff's <br />deputies attempting to arrest him on a domestic violence warrant. Mr. Cook <br />sustained injuries and is permanently paralyzed from the waist down. Since <br />Mr. Cook is unable to completely care for himself and is unable to work in <br />his previous employment, the potential damages were substantial and the <br />demand was in excess of $9 million, including lost wages of about $1 million <br />and future medical expense of over $1.5 million. <br />The County disputed that either it or the Sheriff or his Department or <br />deputies were liable for Mr. Cook's injuries or for any of the claims by <br />either Mr. or Mrs. Cook. It was a warrant for Mr. Cook's arrest obtained by <br />
