February 7, 2011 (Work Session) Page 304 <br />Emergency Management - Adoption of Ordinance Amending Chapter 34, Fire <br />Prevention and Protection of the Cabarrus County Code of Ordinances - Public <br />Hearing - 6:30 P.M. <br />Steve Langer, Fire Marshal, requested a public hearing be held to <br />receive comments on proposed text changes to Chapter 34, Fire Prevention and <br />Protection of the Cabarrus County Code of Ordinances. He reported the <br />proposed amendments will ensure the Ordinance is consistent with county <br />policies and procedures. Mr. Langer also responded to several questions from <br />the Board on the proposed text changes. <br />UPON MOTION of Commissioner Carruth, seconded by Commissioner Measmer <br />and unanimously carried, the Board voted to place the adoption of an <br />ordinance amending Chapter 34, Fire Prevention and Protection of the Cabarrus <br />County Code of Ordinances on the February 21, 2011 Agenda as a New Business <br />item and scheduled a public hearing at 6:30 p.m. <br />Finance - Presentation of Five Additional Five -Year Plans <br />Pam Dubois, Deputy County Manager, presented several 5 -year plans as <br />requested by the Board: <br />Plan No. One: Includes a ;,� sales tax option in FY 2012 and freezes <br />expenditures at FY 2011 levels. <br />Plan No. Two: Includes a ;-A sales tax option in FY 2012 and freezes <br />expenditures at FY 2012 levels. <br />Plan No. Three: Eliminates the 1 -4 cent sales tax option in FY 2012 and <br />freezes expenditures at FY 2011 level. <br />Plan No. Four: Eliminates the 1 ­4 cent sales tax option in FY 2012 and <br />freezes expenditures at FY 2012 level. <br />Plan No. Five: Eliminates the 1 -4 cent sales tax option in FY 2012 and <br />freezes expenditures at FY 2011 level; achieves revenue neutrality in FY <br />2013. <br />She advised that all five (5) plans use a one -time revenue source of <br />$5.7 million in FY 2012 to close out two (2) capital project funds. <br />A discussion ensued. Vice Chairman Poole noted that several of the <br />plans cause the County fund balance to fall below 15 percent, which is not <br />consistent with the Board's policy. Ms. Dubois also responded to questions <br />from the Board. <br />Next, the Board addressed the concept of holding a 1 -4 cent sales tax <br />referendum. Issues addressed included the following: local and statewide <br />sales tax projections; how schools, used as voting precincts, would be <br />affected by a May referendum; costs associated with a May county -wide <br />election vs. the November municipal election; implementation date if the <br />referendum passes; the estimated amount of revenue lost if the referendum is <br />held in November, etc. County staff responded to questions from the Board <br />throughout the discussion. <br />UPON MOTION of Commissioner Carruth, seconded by Vice Chairman Poole <br />and unanimously carried, the Board voted to place the Presentation of Five <br />Additional Five -Year Plans on the February 21, 2011 Agenda as a New Business <br />item. <br />County Attorney - Approval of Grant of Permanent Greenway and Sanitary Sewer <br />Easements for PIN #'s 5620 -21 -1889 and 5620 -22 -9833 <br />Richard Koch, County Attorney, reported in 2007, the Board approved the <br />transfer of certain unimproved real property in the general area of Cabarrus <br />Avenue, White Street, Brown Street and Warren C. Coleman Blvd. to Habitat for <br />Humanity. Although it took Habitat a while to get the project going, he said <br />the property was transferred by deed to them last year. However, the deed <br />contains some restrictions that allow the County to maintain some control <br />over the use of the property. The City of Concord and Habitat for Humanity <br />have requested an easement for a sanitary sewer line and greenway for PIN <br />Numbers 5620 -21 -1889 and 5620 -22 -9833. <br />In response to a question from the Board, he advised approval from the <br />Water and Sewer Authority of Cabarrus County is not needed. <br />
