This resolution shall take effect immediately upon its <br />adoption. <br />Thereupon, upon motion of Commissioner Carruth, seconded by Vice <br />Chairman Poole, the foregoing resolution entitled "RESOLUTION REGARDING ONE - <br />QUARTER CENT (1/4�) LOCAL SALES AND USE TAX AND DIRECTING CABARRUS COUNTY <br />BOARD OF ELECTIONS TO CONDUCT AN ADVISORY REFERENDUM THEREON," was adopted <br />and passed by the following vote: <br />AYES: Chairman White, Vice Chairman Poole and Commissioners Carruth <br />and Burrage <br />NOES: Commissioner Measmer <br />After the vote, Commissioner Carruth and Vice Chairman Poole commented <br />on the following issues: the possible loss of APFO (Adequate Public <br />Facilities Ordinance) revenues, the perils of repeatedly using fund balance <br />to balance the budget, public discussions are needed if services are to be <br />cut or eliminated, unfunded mandates passed down from the Legislature and the <br />need for more media coverage of the Legislature's daily activities. <br />(G -5) BOC - Approval of Cabarrus County's 2011 Legislative Goals <br />Goals: <br />Chairman White reviewed the following Cabarrus County 2011 Legislative <br />• Amend NCGS 14 -399 to allow regulation of delivery of unsolicited <br />telephone books <br />• Reinstate sales tax exemption for public schools <br />• Study the impact to local government finances of exempting <br />nonprofits from the requirement of paying property taxes and review <br />possible payment in lieu of taxes requirements. <br />• Address unfunded mandates (DSS, Schools, Jail, etc.) by providing <br />additional funding, or additional funding sources. <br />• Review the use of local government incentives in business <br />recruitment, in particular, the practice of local governments <br />bidding against each other for projects. <br />• Change NC Rural Center's grant /loan award criteria to more closely <br />match the USDA Rural Development aid requirements (specifically, <br />remove the prohibition against aid to municipalities in Tier 3 <br />counties). <br />• NCACC's top five priority goals and policy statements <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Measmer <br />and unanimously carried, the Board adopted the aforementioned legislative <br />goals for 2011. <br />(H) APPOINTMENTS <br />(H -1) Appointment - Adult Care Home Community Advisory Committee <br />The term of appointment for Elizabeth Ryan ends February 28, 2011. The <br />Regional Ombudsman recommends Ms. Ryan be reappointed for an additional term <br />and she is willing to do so. <br />Ms. Teresa Dakins and Mr. A.L. Fleming have submitted applications to <br />serve on the Adult Care Home Community Advisory Committee. Both have been <br />prequalified by the Regional Ombudsman. <br />UPON MOTION of Vice Chairman Poole, seconded by Commissioner Carruth <br />and unanimously carried, the Board reappointed Elizabeth Ryan to the Adult <br />Care Home Community Advisory Committee for a three -year term ending February <br />28, 2014. By the same vote, the Board appointed Teresa Dakins and A.L. <br />Fleming to the Adult Care Home Community Advisory Committee for one -year <br />terms ending February 28, 2012. <br />(H -2) Appointment - Criminal Justice Partnership Program (CJPP) <br />An appointment is needed to fill the "District Court Judge" position on <br />the Criminal Justice Partnership Program Advisory Board. Judge Michael G. <br />Knox has served in this capacity since 2005. <br />
